32 STATE OF TEXAS CONTRACT OF SALE COUNTY OF HAYS This Agreement, made the 24th day of May , 1982, between James Cummings of Hays County, Texas, hereinafter described as the Seller, and The City of San Marcos, Texas, a municipal corporation located in Hays County, Texas, existing by and under the laws of the State of Texas, acting through authority conferred on its Mayor, Emmie Craddock, by Resolution duly adopted on May 24, 1982 , hereinafter described as Purchaser, upon the following terms and conditions: I. Seller agrees to sell and convey, and Purchaser agrees to purchase, all that certain plot, piece or parcel of land, situate, lying and being in Hays County, Texas, described as follows: 40 acres, more or less, out of the J.M. Veramendi Survey No.2, Abstract M, and being a portion of that tract of 100.13 acres of land conveyed to Frank F. Sharp by B.F. Harper, et ala by deed dated August 9, 1947, and recorded in Volume 138, page 638, Hays County Deed Records. Said tract being a rectangular tract fronting approximately 1352 feet on Old High- way 80 with an approximate depth of 1289 feet and being the most westerly corner of said 100.13 acre Sharp tract. II. The Purchaser agrees to pay for the above described land the sum of $4,500 per acre, payable as follows: $90,000 shall be paid on May 26, 1982 $90,000 shall be paid on July 26, 1982 III. The deed shall be a general warranty deed and shall be duly executed and acknowledged, so as to convey to Purchaser the fee simple of the said premises free of all encumbrances except as stated herein.
