<br />IV. <br /> <br /> <br />Seller shall give and Purchaser shall accept a title such as <br /> <br /> <br />Hays County Abstract Co. will approve and insure. <br /> <br />V. <br /> <br /> <br />Seller shall have a survey made of said premises prior to <br /> <br />May 26, 1982. <br /> <br />VI. <br /> <br /> <br />The risk of loss or damage to said premises by fire, wind, <br /> <br />storm, lighting or flood, until the delivery of the deed, is <br /> <br /> <br />assumed by the Seller. <br /> <br />VII. <br /> <br /> <br />At closing, Seller shall furnish to Purchaser, at Seller's <br /> <br /> <br />sole expense, an Owner's Policy of Title Insurance on the stan- <br /> <br /> <br />dard form in use in the State of Texas, insuring good and <br /> <br />marketable title to the Subject Property in the Purchaser, in the <br /> <br />amount of $180,000.00. <br /> <br />VI I I. <br />Taxes and assessments through 1981 shall be paid by Seller <br />prior to the payment required by Part II of this Contract of Sale. <br />IX. <br />Seller agrees to pay all taxes assessed against the Subject <br />Property for the year 1982. This clause shall survive the <br />closing of title hereunder. <br /> <br />X. <br /> <br /> <br />Upon payment in full by Purchaser to Seller of the payment <br /> <br />hereinabove specified, Seller shall execute and deliver to <br /> <br />Purchaser a general waranty deed conveying the said lands and <br /> <br />premises to Purchaser. The deed shall be delivered at the time <br /> <br />of receipt of the payment required by Part II of this Contract <br /> <br />For Sale. <br /> <br />XI. <br />This agreement constitutes the entire agreement between <br />Seller and purchaser, and Purchaser is not bound by any agree- <br />ment, condition, stipulation, understanding or representation <br />made by any of Purchaser's employees or officers not contained <br />herein.
