<br />Sec. 21-6. Powers and duties. <br /> <br />All duly certified and appointed members of the <br />police department under the authority of the city <br />shall have all the powers and duties conferred on <br />local law enforcement officers by the general laws of <br />the State of Texas, and by the ordinances of the city. <br /> <br />ARTICLE III. FIRE DEPARTMENT <br /> <br />Sec. 21-25. Appointment of members. <br /> <br />(a) All certified personnel employed within the fire <br />department of the city shall be appointed in the <br />manner as provided in Article 1269m, Texas Revised <br />Civil Statutes; provided, however, nothing herein <br />shall be construed so as to include the fire chief <br />who performs as the head of such department within <br />such appointment procedures, other than those pro- <br />vided in section 21-2 of this chapter and Section <br />15 of Article 1269m. <br /> <br />(b) There shall be as many members of the fire depart- <br />ment as the city council shall deem fit and proper, <br />and as authorized pursuant to section 2-31 of this <br />Code dealing with police and fire civil service. <br /> <br />Sec. 21-26. Powers and duties. <br /> <br />All duly certified and appointed members of the fire <br />department under the authority of the city shall have <br />all the powers and duties conferred on local fire depart- <br />ment personnel by the general laws of the State of Texas, <br />and by the ordinances of the city. <br /> <br />ARTICLE IV. LAW ENFORCEMENT DUTIES <br /> <br />Sec. 21-35. Enforcement of laws. <br /> <br />Members of the police department shall be diligent <br />in enforcing within the city the laws of the State of <br />Texas, this Code and any other ordinances of the city, <br />and for such purposes are vested with all the powers <br />and duties conferred on local law enforcement officers <br />by the general laws of the State of Texas and by or- <br />dinances of the city. Members of the police department <br />are declared to be peace officers within the purview of <br />state law. <br /> <br />Sec. 21-36. Arrest without warrant. <br /> <br />Members of the police department shall have the <br />authority to make warrantless arrests as authorized by <br />the Texas Code of Criminal Procedure. <br /> <br />SECTION 2. That section 10-17 of the Code of Ordinances, <br />City of San Marcos, Texas, is hereby amended to read as follows: <br /> <br />Sec. 10-17. Office created. <br /> <br />The office of fire marshal is hereby created. Such <br />office shall be a separate city department. The fire <br />marshal shall report to the fire chief. <br /> <br />SECTION 3. That section 10-18 of the Code of Ordinances, <br />City of San Marcos, Texas, is hereby amended to read as follows: <br />
