<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, APPROVING THE SALE BY
<br />THE CITY OF SAN MARCOS, TEXAS, OF A 54,600
<br />SQUARE FOOT PARCEL OF LAND OUT OF THE J.M.
<br />VERAMENDI SURVEY NO.2, HAYS COUNTY, TEXAS,
<br />TO THE TEXAS DEPARTMENT OF PUBLIC SAFETY;
<br />AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE
<br />A SPECIAL WARRANTY DEED TO THE STATE OF TEXAS
<br />ACTING THROUGH THE TEXAS DEPARTMENT OF PUBLIC
<br />SAFETY AND DECLARING AN EMERGENCY.
<br />
<br />WHEREAS, the City of San Marcos, Texas, is the owner of
<br />54,600 square feet out of the J.M. Veramendi League No.2,
<br />in Hays County, Texas, said parcel of land lying wholly within
<br />that thirty acre tract conveyed by E.S. Sutton and Lillian
<br />Sutton to the City of San Marcos by that deed filed on November
<br />3, 1950, and recorded in Volume 148, pages 138-139, of the
<br />deed records of Hays County, Texas; and,
<br />
<br />WHEREAS, the Texas Department of Public Safety has a pre-
<br />sent need for a site in the San Marcos area on which to con-
<br />struct a Texas Department of Public Safety facility; and,
<br />
<br />WHEREAS, said parcel owned by the City of San Marcos is
<br />uniquely suited for said Texas Department of Public Safety
<br />facility; and,
<br />
<br />WHEREAS, the State of Texas, acting through the Texas Depart-
<br />ment of Public Safety, has the power of eminent domain to acquire
<br />real property for public use; and,
<br />
<br />WHEREAS, the City of San Marcos and the Texas Department
<br />of Public Safety have agreed to the amount to be paid by said
<br />Department for said parcel, said amount to be $27,580.00; and,
<br />
<br />WHEREAS, said purchase price has been tendered by Depart-
<br />ment to City; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That the sale by the City of San Marcos, Texas,
<br />of a parcel of land containing 54,600 square feet out of the
<br />J.M. Veramendi League No.2, in Hays County, Texas and lying
<br />wholly within that thirty acre tract conveyed by E.S. Sutton
<br />and Lillian Sutton to the City of San Marcos by that deed filed
<br />on November 3, 1950, and recorded in Volume 148, pages 138-139,
<br />of the deed records of Hays County is hereby approved. Said
<br />parcel is described more particularly as follows:
<br />
<br />Beginning at the west corner of the said parcel,
<br />which is marked with an aluminum capped iron rod
<br />in a concrete pier on the southeast right of way
<br />line of I.H.35, and from which the south corner of
<br />the said thirty acre tract bears South 370-02'
<br />-2~'West along the said southeast right of way line
<br />a distance of 791.53 feet, and thence South 480-28'
<br />-3~'East along the southwest line of the thirty acre
<br />tract a distance of 840. 06 feet to the said south
<br />corner From the point of beginning a Texas Highway
<br />Department concrete pier with brass tablet right of
<br />way marker, located 200 feet left of the centerline
<br />of I.H. 35 at station 843 + 00, bears South 370-02'-2~'
<br />West a distance of 1988.86 feet.

<br />Thence, from the point of beginnimg,North 370-02'-29"
<br />East along the southeast right of way line of I.H.
<br />35 a distance of 210.00 feet to the north corner of
<br />the said parcel, which is marked with an aluminum
<br />capped iron rod in a concrete pier, and from which
<br />a Texas Highway Department concrete pier with brass
<br />tablet right of way marker, located 200 feet left
<br />of the centerline of I.H. 35 at station 818 + 31
<br />39, bears North 370-02'-29"E a distance of 269.69
