<br />-4- <br /> <br />inconsistent with the provisions of the lease to the Government, shall <br />be suspended. The lease shall be subordinate to the provisions of any <br />existing or future agreement between City and The united States, rela- <br />tive to the operation of maintenance of the airport, the execution of <br />which has been or may be required as condition precedent of the expendi- <br />ture of Federal funds for the development of the airport. <br /> <br />XIII. <br /> <br /> <br />City agrees to waive its right to object to an assignment or transfer <br /> <br /> <br />of rights and privileges by Agricultural Lessee to C.A.F. for the <br /> <br />period of time described in Part I under the terms of the agricultural <br /> <br /> <br />lease agreement entered into by City and Agricultural Lessee on September <br /> <br />1, 1982. C.A.F. shall agree in writing to abide by and accept all the <br /> <br /> <br />provisions of said lease agreement between City and Agricultural Lessee. <br /> <br />XIV. <br />The City of San Marcos Airport Commission shall approve all <br />facilities and utilities to be installed by C.A.F. <br /> <br />XV. <br />It is specifically understood and agreed that nothing contained <br />herein shall be construed as a granting or authorizing the granting of <br />an exclusive right for exercising of an aeronautical activity, nor to <br />conduct any activity which is discriminatory and C.A.F. specifically <br />agrees to operate a non-discriminatory operation. <br /> <br />XVI. <br />If C.A.F. fails to pay any rental or other payment due hereunder <br />or upon its failure to perform any other of the terms of this lease to <br />be observed or performed by C.A.F., or if C.A.F. shall become a bankrupt, <br />or insolvent, or file any debt or proceedings, or take or have taken <br />against C.A.F. in any court pursuant to any statute either of the united <br />States or of the State of Texas a petition in bankruptcy or insolvency <br />or for reorganization or for the appointment of a receiver or trustee <br />for all or a portion of C.A.F.'s property, or if C.A.F. makes an assign- <br />ment for the benefit of creditors, or petitions for or enters into an <br />
