ORDINANCE NO. 1982-43 AN ORDINANCE OF THE CITY COL~CIL OF THE CITY OF SAN MARCOS, TEXAS, AJ1ENDING THE CODE OF ORDINANCES OF SAID CITY TO ADD A NEW CHAPTER TO PROVIDE FOR THE DEMOLITION, VACATION OR REPAIR OF SUBSTANDARD BUILDINGS; DEFINING TERMS; DECLARING UNSAFE BUILDINGS TO BE A NUISANCE; SETTING MINIMUM STANDARDS FOR CON- ~~ TINUED USE AND OCCUPANCY OF STRUCTURES; SETTIN~ STANDARDS FOR REPAIR, VACATION OR DEMOLITION; d DESCRIBING DUTIES OF THE BUILDING INSPECTOR 0 WITH REGARD TO UNSAFE BUILDINGS; PROVIDING ,WJ FOR A BOARD OF ADJUSTMENTS AND APPEALS; PRO- VIDING FOR NOTICE; PROVIDING FOR APPEALS; PROVIDING FOR PUBLIC HEARINGS; SETTING RULES OF PROCEDURE FOR PUBLIC HEARINGS; PROVIDING FOR SEVERABILITY; PROVIDING A PENALTY AND DECLARING AN EFFECTIVE DATE. WHEREAS, in the City of San Marcos, Texas, there are or may in the future be buildings or structures which are dilap- idated, substandard or unfit for human habitation and which constitute a hazard to the health, safety and welfare of the citizens of San Marcos; and, WHEREAS, the City of San Marcos a home-rule city of the State of Texas by virtue of a Home Rule Charter adopted by the voters of said City on February 24, 1967, is expressly authorized by Article 1175(36), Texas Revised Civil Statutes, to adopt an ordinance requiring the demolition or repair of such buildings; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the Code of Ordinances, City of San Marcos, Texas, is hereby amended by adding a chapter, to be numbered 7 1/2, which said chapter shall read as follows: Chapter 7 1/2 DEMOLITION, VACATION OR REPAIR OF SUBSTANDARD BUILDINGS Sec. 7 1/2-1. Scope. The provisions of this Chapter shall apply to all unsafe buildings or structures, as herein de- fined, and shall apply equally to new and existing conditions. Sec. 7 1/2-2. Definitions. The following definitions shall appply in the interpretation and enforcement of this ordinance: (a) Building~ any structure built for the support, shelter or enclosure of persons, animals, chattels or property of any kind which has enclosing walls for fifty (50) percent of its perimeter. The term "building" shall be construed as if followed by the words "or any part thereof." (For the purpose of this code each portion of a building separated from other portions by a fire wall shall be con- sidered as a separate building.) 135
