18 RESOLUTION 1982-46R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT OF LEASE BETWEEN SAID CITY AND JAMES RILEY CUMMINGS FOR A FORTY (40) ACRE TRACT OF LAND FOR FARMING PURPOSES AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas, is the owner of a forty (40) acre tract of land out of the J.M. Veramendi League No. Two (2) by virtue of a deed dated July 26, 1982, from James Riley Cummings and Doris A. Cummings, and recorded in Volume 378, Page 558, Hays County Deed Records; and, WHEREAS, the City of San Marcos, Texas, has received a request from James Riley Cummings that the City lease said forty (40) acre tract to him for farming purposes; and, WHEREAS, George W. Boeker, Director of Public Works for said City, has recommended that said lease be entered into by said City; and, WHEREAS, the City Council of said City hereby finds and determines that the lease of said forty (40) acre tract to James Riley Cummings for farming purposes is in the best interest of said City; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the Agreement of Lease between the City of San Marcos, Texas, and James Riley Cummings for a forty (40) acre tract for farming purposes, a copy of which is attached hereto and incorporated herein for all intents and purposes, be, and is hereby, approved in all respects. PART 2. That the Mayor of said City, Emmie Craddock, be, and she is hereby, authorized to execute said agreement on behalf of said City. PART 3.
