<br />19 <br /> <br />STATE OF TEXAS <br /> <br />AGREEMENT OF LBASE <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />This Agreement of Lease, made and entered into, this <br /> <br />the 12th day of <br /> <br />October <br /> <br />, A.D., 1982 by and between the <br /> <br />City of San Marcos, Texas, a municipal corporation existing <br /> <br />by and through the laws of the State of Texas, acting pursuant <br /> <br />to authority granted its Mayor, Emmie Craddock, by resolution <br /> <br />duly enacted on October 11, 1982 , hereinafter referred to as <br /> <br />Lessor, and James Riley Cummings, of Hays County, Texas, herein- <br /> <br />after referred to as Lessee: <br /> <br />WITNESSETH: <br /> <br />That Lessor does by these presents Lease and Demise unto <br /> <br />Lessee the following described property, lying and being situated <br /> <br />in the City of San Marcos, County of Hays, State of Texas, and <br /> <br />being 40.0 acres of land out of the J.M. Veramendi League No. <br /> <br />Two (2) and being more particularly described as follows: <br /> <br />Commencing at an iron pin in the southeast <br />street line of River Road (old S.H. 80), <br />said iron pin marks the intersection of the <br />southeast street line of River Road and the <br />northeast line of a 30' R.O.W. to the City of <br />San Marcos sewer plant, and also being the <br />most westerly corner of the parcel herein <br />described. <br /> <br />Thence, along the southeast street line of <br />River Road, along an existing fence, N 440 <br />-55'-51" E, a distance of 1351.02' to an iron <br />pin, said iron pin marks the most northern <br />corner of the parcel herein described. <br /> <br />Thence, S 450-00' E, a distance of 1290.10' <br />to a "T" bar fence post set in the south- <br />east line of a 30' R.O.W., said "T" bar fence <br />post marks the most easterly corner of the <br />parcel herein described. <br /> <br />Thence, S 450-00' W, along the southeast line <br />of the 30' R.O.W. a distance of 1351.02' to <br />a small spike set in the corner fence post, said <br />spike is the most southern corner of the parcel <br />herein described, and also marks the intersec- <br />tion of the southeast line of the previously <br />
