24 STATE OF TEXAS FIRE PROTECTION AGREEMENT COUNTY OF HAYS KNOW ALL MEN BY THESE PRESENTS: That on the 12th day of October, A.D., 1982 the City of San Marcos, a municipal corporation located in Hays County, Texas, and existing by and under the laws of the State of Texas, acting through authority conferred on its Mayor, Emmie Craddock, by Resolution duly adopted on October 11, 1982 , hereinafter referred to as "City", and the County of Hays, Texas, acting through authority conferred on the County Judge of Hays County, Walter W. Burnett, by Resolution duly adopted on October 25, 1982, hereinafter "County", entered into this Fire Protection Agreement on the following terms and conditions: Witnesseth I. That this Fire Protection Agreement is made and entered into pursuant to the authority granted by the Texas Interlocal Cooperation Act, Art. 4413(32c), Texas Revised Civil Statutes, hereinafter "Act". II. The purpose of this Agreement is to provide for the protection of life and property from fire in those areas of County which are located outside the corporate limits of City and which are not pro- vided fire protection services other than those previously supplied by City. The intent of the parties is that such protection shall be provided for the term of this Agreement with the understanding that County assume sole responsibility for fire protection services for said areas by September 30, 198J, or enter into an agreement with the City at that time which guarantees the County's equitable sharing of both capital and operational expenses of the City Fire Department. III. County shall be responsible for equipping and making available at all times three fire trucks which shall be used for firefighting
