<br />-2- <br /> <br />purposes in those areas described in Part II. One of the three <br /> <br /> <br />fire trucks shall be City Fire Truck #309, and City hereby agrees <br /> <br /> <br />that said Fire Truck #309 shall be deeded to the County. All <br /> <br />volunteers will operate #309 which will be housed in County Pre- <br /> <br />cinct Barn #1. After this year is over #309 will belong to the <br /> <br /> <br />County for its own use. If County is unable to assume sole <br /> <br />responsibility for fire protection services for said areas by <br /> <br /> <br />September 30, 1983, City Fire Truck #309 shall be returned to City. <br /> <br />IV. <br />Said three fire trucks shall be housed in the County at <br />sites to be selected by County and shall be used to fight fires <br />which originate in the County. <br /> <br />V. <br /> <br /> <br />Volunteer members of the City of San Marcos Fire Department, <br /> <br /> <br />whether or not those members are residents of City, shall be primarily <br /> <br />responsible for providing fire protection services in those areas of <br /> <br />County described in Part II. Said volunteers shall have rights of <br /> <br /> <br />access pursuant to departmental policy to the communication system <br /> <br />of City maintained by City for use by the City of San Marcos Fire <br /> <br /> <br />Department. Provided, however, that said volunteers shall continue <br /> <br />to be utilized to fight fires occurring within the corporate limits <br /> <br /> <br />of City to as great an extent as is practicable while maintaining <br /> <br /> <br />City's responsibilities pursuant to this provision. And provided <br /> <br /> <br />further that the Fire Chief of City shall at all times be in con- <br /> <br /> <br />trol of both paid and volunteer members of the City of San Marcos <br /> <br /> <br />Fire Department. <br /> <br />VI. <br />The City will have no responsibility for maintenance of <br />County fire trucks. <br /> <br />VII. <br /> <br /> <br />Should a fire occur in those areas described in Part II <br /> <br />of this Agreement which, in the opinion of the Chief of the volun- <br /> <br /> <br />teer members of the San Marcos Fire Department, is too extensive <br /> <br />to be handled solely by said volunteers, said Chief or his/her <br /> <br /> <br />designee shall request assistance from the City of San Marcos Fire <br /> <br /> <br />Department.
