86 THE STATE OF TEXAS AGREE~ffiNT OF LEASE COUNTY OF HAYS KNOW ALL MEN BY THESE PRESENTS: This agreement, made this 13th day of Decewber , A.D. 19 82 , between Emmett F. McCoy, as Lessor, and the City of San ~1arcos, Texas, a municipal corporation located in Hays County, Texas, and existing by and under the laws of the State of Texas, acting through authority conferred on its Mayor, Emmie Craddock, by Resolution duly adopted on December 13, 1982, as Lessee: WITNESSETH 1. That the Lessor does hereby lease to the Lessee the following described premises situated in Hays County, Texas, to- wit: A parcel of land containing 14,400 square feet out of the F.M. Stovall Survey No.1, Hays County, Texas, and lying wholly within that 307.12 acre tract conveyed by First Investors Leasing Corpora- tion to Emmett F. McCoy by that deed dated 8 March 1974, filed on 11 March 1974, and recorded on 12 March 1974 in the deed records of said county. This 14,400 square foot parcel is shown on a plat of a survey of said parcel by Charles R. Swart, Surveyor, dated 3 September 1982, and is described by metes and bounds as follows: Beginning at the west corner of the 14,400 square foot parcel, which is marked with an aluminum capped steel rod monument on the southeast line of a fifty foot wide private road; from this west corner an iron pipe marking the east corner of Lot 9 of Valley View West, an unrecorded subdivision bears North 440-59'-00"W a distance of 50.00 feet, and thence North 450-0l'-00"E a distance of 760.28 feet. From this west corner an iron pipe marking the point of curvature on the southeast line of Lot 8 of said subdivision bears North 440-59'-00" West a distance of 50.00 feet, and thence South 450-01'-00" West a distance of 309.71 feet. Thence, from the point of beginning, North 450 -01'-00" East along the southeast line of the pri- vate road a distance of 120.00 feet to the north corner of the l4~400 square foot parcel, from which an aluminum capped steel rod witness corner bears South 450-01'-00" West a distance of 2.00 feet; thence, from the north corner of this parcel, South 440-59'-00" East a distance of 120.00 feet to the east corner of this parcel, from which an aluminum capped steel rod witness corner bears South 450-01' -00" West a distance of 2.00 feet;
