<br />86 <br /> <br />THE STATE OF TEXAS <br /> <br />AGREE~ffiNT OF LEASE <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />This agreement, made this 13th day of Decewber <br /> <br />, A.D. <br /> <br />19 82 , between Emmett F. McCoy, as Lessor, and the City of <br /> <br />San ~1arcos, Texas, a municipal corporation located in Hays <br /> <br />County, Texas, and existing by and under the laws of the State <br /> <br />of Texas, acting through authority conferred on its Mayor, <br /> <br />Emmie Craddock, by Resolution duly adopted on December 13, 1982, <br /> <br />as Lessee: <br /> <br />WITNESSETH <br /> <br />1. That the Lessor does hereby lease to the Lessee the <br /> <br />following described premises situated in Hays County, Texas, to- <br /> <br />wit: <br /> <br />A parcel of land containing 14,400 square feet <br />out of the F.M. Stovall Survey No.1, Hays County, <br />Texas, and lying wholly within that 307.12 acre <br />tract conveyed by First Investors Leasing Corpora- <br />tion to Emmett F. McCoy by that deed dated 8 March <br />1974, filed on 11 March 1974, and recorded on 12 <br />March 1974 in the deed records of said county. <br />This 14,400 square foot parcel is shown on a plat <br />of a survey of said parcel by Charles R. Swart, <br />Surveyor, dated 3 September 1982, and is described <br />by metes and bounds as follows: <br /> <br />Beginning at the west corner of the 14,400 square <br />foot parcel, which is marked with an aluminum <br />capped steel rod monument on the southeast line <br />of a fifty foot wide private road; from this west <br />corner an iron pipe marking the east corner of Lot <br />9 of Valley View West, an unrecorded subdivision <br />bears North 440-59'-00"W a distance of 50.00 feet, <br />and thence North 450-0l'-00"E a distance of 760.28 <br />feet. From this west corner an iron pipe marking <br />the point of curvature on the southeast line of <br />Lot 8 of said subdivision bears North 440-59'-00" <br />West a distance of 50.00 feet, and thence South <br />450-01'-00" West a distance of 309.71 feet. <br /> <br />Thence, from the point of beginning, North 450 <br />-01'-00" East along the southeast line of the pri- <br />vate road a distance of 120.00 feet to the north <br />corner of the l4~400 square foot parcel, from which <br />an aluminum capped steel rod witness corner bears <br />South 450-01'-00" West a distance of 2.00 feet; <br /> <br />thence, from the north corner of this parcel, South <br />440-59'-00" East a distance of 120.00 feet to the <br />east corner of this parcel, from which an aluminum <br />capped steel rod witness corner bears South 450-01' <br />-00" West a distance of 2.00 feet; <br />
