<br />Sublease No.: DTFA07-82-L-01189 <br />Outer Marker Site and Access Road <br />Runway 12, Municipal Airport <br />San Marcos, Texas <br /> <br />i. Except as the parties may otherwise agree, pending final <br />resolution of a claim by the Sublessor arising under the <br />sublease, the Sublessor shall proceed diligently with the <br />performance of the sublease and its terms in accordance with <br />the Contracting Officer's decision. <br /> <br />6. No Member of Congress or Resident Commissioner shall be admitted <br />to any share or part of this sublease or to any benefit to arise therefrom. <br /> <br />7. The Sublessor warrants that no person or selling agency has been <br />employed or retained to solicit or secure this sublease upon agreement or <br />understanding for a commission, brokerage, percentage or contingent fee, <br />except bona fide employees or bona fide established commercial or selling <br />agencies maintained by the Sublessor for the purpose of securing business. <br />For breach or violation of this warranty, the Government shall have the <br />right to annul this without liability, or in its discretion to deduct from <br />amounts otherwise due under this sublease or other consideration, the full <br />amount of such commission, brokerage, percentage, or contingent fee. <br /> <br />8. All notices sent to the parties under the sublease shall be <br />addressed as follows: <br /> <br />To the Sublessor: <br />Hopkins, San Marcos, Texas <br /> <br />City of San Marcos, City Hall, 630 East <br />78666. <br /> <br />To the Government: Department of Transportation, Federal <br />Aviation Administration, P.O. Box 1689, ATTN: ASW-56, Fort Worth, <br />Texas 76101. <br /> <br />9. This sublease is subject to the additional provlslons set forth <br />below, or attached hereto and incorporated herein.
