<br />Sublease No.: DTFA07-82-L-01189 <br />Outer Marker Site and Access Road <br />Runway 12, Municipal Airport <br />San Marcos, Texas <br /> <br />10. NON-RESTORATION: <br /> <br />It is hereby agreed between the parties that upon termination of <br />.its occupancy the Government shall have no obligation to restore and/or <br />rehabilitate, either wholly or partially, the property which is the <br />subject matter of this sublease. It is further agreed that the Government <br />may abandon in place any or all of the structures and equipment installed <br />in or located upon said property by the Government during its tenure. <br />Notice of abandonment will be conveyed to the Sublessor in writing. <br /> <br />11. RIGHTS FROM OTHERS: <br /> <br />The Sublessor will acquire the rights from others for land <br />required for this Outer Marker facility. Copies of the acquisition <br />document(s) will be forwarded with this sublease after the sublease has <br />been executed on behalf of the City of San Marcos. <br /> <br />12. LESSOR/LESSEE AGREEMENT: <br /> <br />Sublessor is presently the lessee under a certain Agreement of <br />Lease dated December 13 , 1982 , between Emmett F. McCoy. as <br />Lessor and the City of San Marcos, Texas, as Lessee, a copy of which is <br />attached hereto and made a part hereof and marked Exhibit A, and <br />which copy has been initialed by the parties hereto. <br /> <br />13. The Government has received a copy of those restrictive covenants <br />affecting said premises filed of record in Volume 259, Page 102, Hays <br />County Deed Records, and this sublease is expressly entered into with knowledge <br />of and subject to said restrictions. <br /> <br />5 <br />
