<br />Therefore, you and we agree as follows: <br /> <br />1. Definitions <br /> <br />1.1 ACH or Automated Clearing House. A funds transfer system governed by <br />the NACHA Rules that provides for the interbank clearing of electronic <br />entries for participating depository institutions. <br /> <br />1.2 Authorization or Authorized. The approval of a request for a POS <br />Transaction by the Bank System or a third party providing processing for <br />the Bank System. <br /> <br />1.3 Authorization Code. A code provided by the Bank System to a Merchant <br />indicating that a POS Transaction has been Authorized. <br /> <br />1.4 Bank System. The telecommunication and processing system (including <br />hardware and software) operated by us or on our behalf that processes <br />(authorizes or declines) POS Transactions. <br /> <br />1.5 Check. A check drawn on a Consumer's Account. <br /> <br />1.6 Claim. One or more of the following criteria constitutes the basis for a <br />reversed POS transaction: <br />(a) the transaction was fraudulent and the transaction receipt was signed <br />(b) the transaction was fraudulent and the transaction receipt was not <br />signed by the Consumer <br />(c) the transaction has been previously paid <br />(d) the Consumer claims that there was an error in the processing the <br />transaction <br />(e) the financial institution holding the Consumer's account claims that <br />there was an error in the processing of the transaction <br />(f) the financial institution holding the consumer's account has requested <br />and not received a copy of the transaction receipt <br />(g) the Consumer's account has insufficient funds <br />(h) the Consumer effectively places a stop payment on a check <br />(i) the Consumer presenting the check is not the person whose name is <br />imprinted on the check. <br /> <br />In addition, if you have imaging equipment, the following are also bases <br />for a reversed POS transaction: <br /> <br />(j) the Consumer's complete residence address and residence phone <br />number (including area code) are not imprinted or legibly written on <br />the check <br />(k) the transaction was not imaged. <br /> <br />1.7 Consumer. The natural person who presents a Check to you for a <br />personal, family or household payment. <br /> <br />1.8 Consumer's Account. A checking account at a U.S. bank, savings and <br />loan association, credit union or other depository institution that is <br />accessed by the Check presented by the Consumer. <br /> <br />1.9 Conversion Only or Conversion Only SelVice. The minimum conversion <br />process ofa Check to an electronic debit to the Consumer's Account. <br /> <br />2 <br /> <br />I <br /> <br />I <br /> <br />I <br />
