<br />I <br /> <br />I <br /> <br />3.6 You will key in the Transaction amount and any other information as <br />prompted by the POS Terminal. You will include any applicable tax with <br />the amount of the POS Transaction. <br /> <br />3.7 You must obtain Authorization for each POS Transaction before you <br />complete the transaction. [NOTE: You will not receive Authorization for <br />POS Transactions that exceed a preassigned dollar limit. The dollar limit is <br />set on a number of factors, including your Merchant Category Code. You <br />can ask for more details about this limit from a Bank of America sales <br />officer.] <br /> <br />3.8 If the Transaction is approved by the Authorization system, you will <br />require Consumer to confirm his or her authorization of the Conversion <br />Service by signing the Transaction Receipt provided by the Bank System. <br />At a minimum, the Transaction Receipt will include all of the information <br />required by NACHA and Visa Rules. <br /> <br />3.9 You will provide each Consumer who completes a Transaction through <br />Electronic Check Services with: (a) the Consumer's Check, which you <br />have voided; (b) a copy of the Consumer's signed Transaction Receipt; and <br />(c) a receipt containing specific information as to the purchase or sale of <br />goods or services for which payment was made, as required by law. Any <br />required receipt referenced in 3.9(c) is your sole responsibility. If you rely <br />on the Terminal Receipt in order to comply with this requirement, you <br />represent and warrant to us that the Terminal Receipt meets all <br />requirements applicable to your business. You will void the Check by <br />writing the words "Void Converted to Electronic Payment" in large letters <br />across the face of the Check. <br /> <br />4. Other Electronic Check Services Requirements <br /> <br />4.1 You will retain a copy of each Transaction Receipt for a minimum of two <br />(2) years, or such longer period as may be required by law, or NACHA or <br />Visa Rules, in a complete and readable manner, by which an individual <br />Transaction Receipt may be retrieved to respond to an inquiry by the <br />Consumer. <br /> <br />4.2 You may not add any fee or charge to Consumers for use of Electronic <br />Check Service. <br /> <br />4.3 For each Transaction for which you receive Authorization, Bank System <br />will automatically generate an electronic debit entry to the Consumer's <br />Account, in accordance with the information input to the POS Terminal. <br />You understand and agree that POS Transactions are considered ACH <br />transactions, and that Checks successfully processed are not subject to the <br />Uniform Commercial Code rules regarding checks. <br /> <br />4.4 You must make the Electronic Check Service available at each checkout <br />lane at which paper checks are accepted, unless specifically authorized in <br />writing by us. <br /> <br />8 <br /> <br />I <br />
