<br />9. POS Transactions for Return of Goods or Services <br /> <br />I <br /> <br />9.1 You may process a void of a POS Transaction at the particular POS <br />Terminal that issued the void and only within 10 minutes of the POS <br />Transaction being voided. In the event that more than 10 minutes have <br />elapsed, you must follow your usual policy regarding return of goods or <br />services paid by check. <br /> <br />9.2 You may not use the Electronic Check Service or the POS Terminal to <br />process payment to the Consumer for returned good or services. <br /> <br />10. Disputed Transactions and Reversed POS Transactions <br /> <br />10.1 You understand and agree that Consumer has certain rights by law, as well <br />as under NACHA Rules and Visa Rules, to dispute POS Transactions. <br />You understand and agree that the depository institution for a Consumer's <br />Account may process a Reversed POS Transaction in accordance with the <br />Service descriptions in Sections 5 through 7. The amount of any Reversed <br />POS Transaction is immediately due to us from you. We may <br />automatically debit the Deposit Account or take any other action allowed <br />under this Agreement for amounts due us from you in order to collect the <br />amount of the disputed or Reversed POS Transaction, plus any applicable <br />Fees. <br /> <br />10.2 You will cooperate with us to resolve any disputed or Reversed POS <br />Transactions, including but not limited to providing copies of the <br />Transaction Receipt and documentation of the sale. IfNACHA or Visa <br />Rules permit you to rebut the Reversed POS Transaction, you must submit <br />your dispute to us following those Rules or our procedures within the time <br />specified. <br /> <br />I <br /> <br />11 <br /> <br />I <br />
