<br />I <br /> <br />13. P~S Terminal and Communication Services <br /> <br />13.1 You will use only POS Terminals approved for use in the Electronic <br />Check Service by us. We will provide appropriate software and may <br />provide POS Terminals for use with the Electronic Check Services at the <br />Fees described in the Fee Schedule. <br /> <br />13.2 You are solely responsible for the maintenance of POS Terminals, any <br />additional communication services or equipment at your locations, as well <br />as the telecommunications lines and equipment necessary to transmit data <br />between you and Bank System or any third party whose services are used <br />in conjunction with the Electronic Check Service. <br /> <br />14. Fees. Charges. Payments to Us <br /> <br />14.1 You will pay the Fees related to the Electronic Check Services in <br />accordance with the Fee Schedule. All Fees under this Agreement are <br />subject to change in accordance with the provisions of this Agreement. <br /> <br />14.2 You will pay to us immediately the amount of a Reversed POS <br />Transaction, chargeback or fine from the Card Organization related to <br />your use of the Electronic Check Service. <br /> <br />I <br /> <br />14.3 To the extent we have paid or may pay a disputed or Reversed POS <br />Transaction, you are obligated to reimburse us. In the event you do not <br />reimburse us, we will have all the rights and remedies and may assert <br />Claims on behalf of one or more Consumers. <br /> <br />15. Use of Service Marks and Advertising <br /> <br />You will display the proprietary names and symbols associated with POS <br />Transactions only in compliance with our instructions or Visa Rules, and only <br />while this Agreement is in effect, or until we or the Card Organization notifies <br />you to stop using them. You will not indicate or suggest in any way that we or <br />Card Organization endorses your products or services. <br /> <br />13 <br /> <br />I <br />
