<br />I <br /> <br />1.1.4 Any prOVlSlons in this Agreement pertammg to the City's review, approval and/or <br />acceptance of written materials prepared by the Consultant and/or its subconsultants, contractors, <br />and subcontractors in connection with this Agreement will not diminish the Consultant's <br />responsibility for the materials. <br /> <br />1.1.5 Consultant will perform all of its services in coordination with the City. The Consultant <br />will advise the City of data and information the Consultant needs to perform its services, and the <br />Consultant will meet with City representatives at mutually convenient times to assemble this data <br />and information. <br /> <br />1.1.6 The Consultant will provide a full-service project manager to the Project, as well as <br />executive and support services to provide Project oversight support, support resources and <br />project management. The Consultant will make the resources of the Project Manager available <br />to accomplish the scope of work and to perform specialized tasks as necessary to satisfactorily <br />perform its services as identified in this Agreement. The Consultant acknowledges and agrees <br />that in the course of providing services hereunder, it shall not have any authority to act as agent <br />for or otherwise obligate the City to pay for services or materials for which the City has not <br />separately contracted for and that such actions for City may only be undertaken by the City's <br />duly authorized representatives. <br /> <br />1.2 PHASE I-OVERALL FUNCTIONS FOR THE PROJECT <br />I The Consultant will: <br /> <br />1.2.1 Designate Ed Lee, AlA, as the Consultant's Project Manager (the "PM") who will serve <br />as the primary point of contact for the City. The Consultant, through its PM, will provide all <br />general leadership and management functions as required of a PM which include but are not <br />limi ted to: <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />f) <br /> <br />tracking budgets; <br />monitoring schedules; <br />overseeing quality of all aspects of the project; <br />communicating with the project team (including the Design-Builder); <br />handling coordinating issues, documentation, minutes, action items, and approvals <br />to move the project through all its various phases; <br />providing direct interface with the developer (JQH), the community, end-users <br />and other stakeholders; <br />and briefing City staff and City Council as necessary. <br /> <br />g) <br /> <br />Jim Broaddus will serve as the Consultant's Project Executive and advisor to the City and <br />the PM. <br /> <br />1.2.2 Review and provide advice to the City regarding the overall Project budget including <br />hard and soft costs. (i.e., construction, design, management, testing, furnishings, equipment, <br />permitting, connection fees, contingency funds, etc.). During the Construction Phase, the <br />Consultant will review with the City at monthly intervals the level of effort required of the <br /> <br />I <br /> <br />Broaddus OR Contract <br /> <br />2 <br />
