<br />TEXAS: <br /> <br />PART 1. Upon review of the evidence in this matter, including the evidence included in the <br />record of the decision by the Commission and comments offered at the public hearing held by the <br />City Council, the City Council sustains the assessment oftwo penalty points for the October 9, 2005 <br />incident involving arrest of a person for possession of a controlled substance on the premises of <br />Bum's Billiards, and finds that this assessment is supported by the preponderance of the credible <br />evidence. <br /> <br />PART 2. Upon review of the evidence in this matter, including the evidence included in the <br />record of the decision by the Commission and comments offered at the public hearing held by the <br />City Council, the City Council sustains the assessment of two penalty points assessed for the October <br />10, 2005 incident involving arrest of a person for public intoxication on the premises of Bum's <br />Billiards, and finds that this assessment is supported by the preponderance ofthe credible evidence. <br /> <br />P ART 3. Upon review of the evidence in this matter, including the evidence included in the <br />record of the decision by the Commission and comments offered at the public hearing held by the <br />City Council, the City Council sustains the assessment of two penalty points for the October 22, <br />2005 consuming after hours citation on the premises of Bum's Billiards, and finds that this <br />assessment is supported by the preponderance ofthe credible evidence. <br /> <br />PART 4. Upon review ofthe evidence in this matter, including the evidence included in the <br />record of the decision by the Commission and comments offered at the public hearing held by the <br />City Council, the City Council sustains the assessment of two penalty points for the November 5, <br />2005 incident involving arrest of a patron of Bum' s Billiards for driving while intoxicated, and finds <br />that this assessment is supported by the preponderance of the credible evidence. <br /> <br />P ART 5. Upon review of the evidence in this matter, including the evidence included in the <br />record of the decision by the Commission and comments offered at the public hearing held by the <br />City Council, the City Council sustains the assessment of two penalty points for the November 23, <br />2005 incident involving arrest of a person for possession of a controlled substance on the premises of <br />Bum's Billiards, and finds that this assessment is supported by the preponderance of the credible <br />evidence. <br /> <br />P ART 6. The City Council, on the basis that the total of penalty points sustained by the <br />determinations in Part 1 through Part 5 of this Resolution is six or more, the Council modifies the <br />decision of the Commission in the following respects: <br /> <br />1. Two consecutive weekends (defined as Thursday, Friday, Saturday) of suspension beginning <br />Thursday, April 13, 2006. <br /> <br />I <br /> <br />II <br /> <br />2. One or more cameras to be installed to record activities in the parking lot during all operating <br />hours of the business, and one hour before and one hour after the operating hours. The purpose of I <br />the camerae s) is to provide the management staff with information about possible misconduct in the <br />parking lot so management can take corrective action. <br />
