Thomas Rhoades, ETR Development Buda, TX, stated that part of the PDD was to acquire and purchase this portion of easement for $14,000 and asked Council for positive consideration. Dianne Wassenich, 11 Tanglewood, pointed out the same issues in the engineering report of the Casey Development Project would also affect this portion of the river. She told the Council that anything that they did to aid in the progress of this development was a bad idea. There being no further comments, the Public Hearing was closed at 7:47 p.m. MOTION: Upon a motion made by Council Member Thomaides and a second by Council Member Thomason the City Council voted (6) for and (1) opposed, Council Member Becak, to approve Ordinance 2012 -03, as previously captioned. The motion carried. NON - CONSENT AGENDA 16. Reconsider Ordinance 2011 -77 approving an amendment to the Future Land Use Map from "LDR" Low Density Residential to "C" Commercial for a 2.119 acre, more or less, tract of land located at 1620 Old Ranch Road 12; amending the Official Zoning Map of the City by rezoning this tract from "SF -6" Single - Family Residential District to 'INC" Neighborhood Commercial District; and including procedural provisions. No action taken. 17 Consider approval of Ordinance 2012 -04, on the first of two readings, changing the rate for customers for once per week collection of residential solid waste and single stream recycling service from $15.51 t $16.28 per month, and increasing the rate for single stream multi - family recycling service from $4.40 per month to $4.62 for such service; approving the Texas Disposal Waste 2012 contract rates; including procedural provisions; and providing an effective date. MOTION: Upon a motion made by Council Member Porterfield and a second by Council Member Thomason, the City Council voted (7) and (0) opposed, to approve Ordinance 2012 -04, as previously captioned. The motion carried unanimously. Council provided direction to Staff to provide a yearend report of the single stream recycling program with TDS to Council following the March closing date. 18. Consider approval of Ordinance 2012 -05, on the first of two readings, amending the City's 2011 - 2012 budget to budget expenditures in the total sum of $32,517.67 from state seized asset funds to provide funding for forensic laboratory services under an interlocal agreement with the City of Austin, Texas; and providing an effective date. MOTION: Upon a motion made by Council Member Thomason and a second by Council Member Prather, the City Council voted (7) for and (0) opposed, to approve Ordinance 2012 -05, as previously captioned. The motion carried unanimously.
