5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan <br />is revised to change the future land use designation for the following real property from "LDR" <br />Low Density Residential to "MDR" Medium Density Residential: <br />Street address: East of Shadow Point along Rush Haven and north of Trestle Tree <br />Size: 10.347 acres, more or less <br />Legal description: As described in the Amending Plat of Blocks E, F, H and I, Blanco <br />River Village Section One Subdivision, attached hereto as Exhibit "A" and made a part <br />hereof for all purposes. <br />SECTION 2. The Development Standards and associated Concept (Land Use) Plan for <br />the Blanco River Village Planned Development District "PDD ", consisting of 103.788 acres of <br />land, more or less, in the 1400 through 1900 blocks of State Highway 21 (the "Project Site ") as <br />originally approved by Ordinances numbered 2004 -61 and 2008 -49 are amended as provided in <br />and superseded by the Blanco River Village Planned Development District Amended and <br />Restated Development Standards attached hereto as Exhibit `B" and made a part hereof for all <br />purposes. <br />SECTION 3. The Blanco River Village Planned Development District Amended and <br />Restated Development Standards, attached to this ordinance as Exhibit "B" (the "Regulations "), <br />are approved and adopted to regulate the development of the Project Site. The Project Site will <br />be bound by the provisions of the Regulations as though they were conditions, restrictions and <br />limitations on the use of the Project Site under the City's zoning ordinances. Any person, firm, <br />corporation or other entity violating any provisions of the Regulations shall be subject to all <br />penalties that apply to violations of the zoning ordinances of the City of San Marcos, as <br />amended. Any person, firm, corporation or other entity violating any provisions of the <br />Regulations shall be subject to a suit by the City for an injunction to enjoin the violation as <br />though the Regulations were conditions, restrictions and limitations on the use of the Project Site <br />under the City's zoning ordinances. <br />SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City <br />Code upon conviction. <br />SECTION 5. After its original passage, this ordinance will be subject to reconsideration <br />at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is <br />reconsidered and approved, it shall become effective thereafter. <br />
