5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is revised to change the future land use designation for the following real property from "LDR" Low Density Residential to "MDR" Medium Density Residential: Street address: East of Shadow Point along Rush Haven and north of Trestle Tree Size: 10.347 acres, more or less Legal description: As described in the Amending Plat of Blocks E, F, H and I, Blanco River Village Section One Subdivision, attached hereto as Exhibit "A" and made a part hereof for all purposes. SECTION 2. The Development Standards and associated Concept (Land Use) Plan for the Blanco River Village Planned Development District "PDD ", consisting of 103.788 acres of land, more or less, in the 1400 through 1900 blocks of State Highway 21 (the "Project Site ") as originally approved by Ordinances numbered 2004 -61 and 2008 -49 are amended as provided in and superseded by the Blanco River Village Planned Development District Amended and Restated Development Standards attached hereto as Exhibit `B" and made a part hereof for all purposes. SECTION 3. The Blanco River Village Planned Development District Amended and Restated Development Standards, attached to this ordinance as Exhibit "B" (the "Regulations "), are approved and adopted to regulate the development of the Project Site. The Project Site will be bound by the provisions of the Regulations as though they were conditions, restrictions and limitations on the use of the Project Site under the City's zoning ordinances. Any person, firm, corporation or other entity violating any provisions of the Regulations shall be subject to all penalties that apply to violations of the zoning ordinances of the City of San Marcos, as amended. Any person, firm, corporation or other entity violating any provisions of the Regulations shall be subject to a suit by the City for an injunction to enjoin the violation as though the Regulations were conditions, restrictions and limitations on the use of the Project Site under the City's zoning ordinances. SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 5. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, it shall become effective thereafter.
