<br />Sec. 42.127. btH~stigati6Ds Studies and reports. <br /> <br />The historic preservation commission may make these in-.estigations and studi~ of matter relating <br />to the protection, enhancement, perpetuation or use oflocal historic landmarks and historic districts and <br />to the restoration oflandmarks as the commission may, from time to time, deem necessary or appropriate <br />for the effectuation of the purposes of this chapter, and may submit reports and recommendations as to <br />these matters to the mayor city council and other agencies of the city. In making these investigations <br />tmd studies, the commission may hold the public hearings as it may deem necessary or appropriate. <br /> <br />Sec. 42.128. Ordinary maintenance allowed; public safety. <br /> <br />(a) Nothing in this chapter shall be construed to prevent the ordinary maintenance or repair of any <br />exterior features in ftfi a local historic district or of any local landmark that does not involve a change <br />in design, material, eeffir,-or outer appearance other than color thercof. <br /> <br />(b) Nothing in this chapter shall prevent the construction, reconstruction, alteration, restoration or <br />demolition of any feature which the building inspector or similar official shall certify is required for the <br />public safety because of an unsafe or dangerous condition. <br /> <br />Sec. 42.129. ~biDteDaDee, repair aDd e Construction and repair standards. <br /> <br />(a) Ncither the 0-,l,11er of nor the person in eharge of a 3trueturc -Nithin an historic distriet or of a <br />designated ltlfidma-rk shtl.'ll permit the strueture or landmark to fan into a state of disrcpa-ir that ma-)' result <br />in thc detcriorlttion of afty exterior appurtenm1ee or architectural feature so as to produee or tend to <br />produce, in the judgment oftoc historic preservation eommission, a dctrimental effect upon the eharaeter <br />ofthc distriet as a ',-.hole or the life and eharaeter of the IMldmark or structure in question, including but <br />not limited to: <br /> <br />(1) The dcteriomtion of cxterior v.'tl::lls or other -.ertictl.'l support. <br /> <br />(2) The deteriomtion of roofs or other horizontal mem.bers. <br /> <br />(3) The dcteriorlttion of exterior ehimneys. <br /> <br />(4) The dcterioration or crumbling of exterior plaster or mortar. <br /> <br />(6) Thc ineffective -,vaterproofing of exterior v,'ftlls, roofs Md fotlfidation, induding br9ken -,vindo-,-,'s <br />or doors. <br /> <br />(7) The deterioration of aft)' featlJ:fC so as to ereate or permit the ercation of any hazardous or unsafe <br />eondition. <br /> <br />B*ill New construction and existing buildings and structures and appurtenances thereof within <br />local historic districts that are moved, reconstructed, materially altered, or repaired or ehftfiged in eolor <br />shall be visually compatible with other buildings to which they are visually related generally in terms <br />of the following factors; provided, however, these guidelines shall apply only to those exterior portions <br />of buildings and sites visible from the main streets of each historietl.'l district from adiacent public streets: <br /> <br />(1) Height. The height of a proposed building shall be visually compatible with adjacent buildings. <br /> <br />(2) Proportion of building's front fac;ade. The relationship of the width of a building to the height <br />of the front elevation shall be visually compatible to the other buildings to which it is visually <br />related. <br /> <br />(3) Proportion of openings within the facility. The relationship of the width of the windows in a <br />building shall be visually compatible with the other buildings to which it is visually related. <br /> <br />(4) Rhythm of solids to voids infrontfacades. The relationship of solids to voids in the front fac;ade <br />of a building shall be visually compatible with the other guidelines to which it is visually related. <br /> <br />6 <br />
