(d) After the public hearing the historic preservation commission shall submit a final report with its recommendations and those of the planning and zoning commission and a draft of a proposed ordinance to the city council for its action. Sec. 42.102. Local Dgistricts and landmarks established. There are established the following local historicttt districts within the corporate limits: (1) The Belvin Street historicttt district. (2) The San Antonio Street historicttt district. (3) The Downtown historicttt district. Sec. 42.103. Designation of local historic landmarks. (a) There is ttre established the following: local historical landmarks within the corporate limits~ :- The Oak Heights Live Oak Tree located in the 500 Block of Franklin Drive. (b) Upon recommendation ofthe historic preservation commission and upon review by the planning and zoning commission, the city council may, aftcr holding a public hcftfing preceded by giving suffieient vvTitten notice to the oVvncrs tl.1ld occUf'ftnts of the affected propcrty flfid posting notice in its nornutl lllflfi1ler, adopt an ordinance designating one or more local historic landmarks. Before adopting the ordinance. the council will conduct a public hearing for which notice has been published in a newspaper of general circulation in the city. and written notice sent to the owner of the proposed landmark at least ten days before the hearing. The designation will be based on the following criteria: (1) Historical, architectural and cultural significance;:- (2) Suitability for preservation or restoration; and :- (3) Educational value. (c) In order for any property to be designated in the ordinance, it must in addition meet the criteria established for inclusion of the property in the National register of Historic Places. (d) Upon adoption of the ordinance, the owners and occupants of each designated local historic landmark shall be given written notification of the designation by the city council. (e) One copy of the ordinance shall be filed by the historic pfescrvation conlmission in the office of the registrar of deeds of the county in which the property is located. (f) The ordinance shall also provide for a suitable sign or marker on or near the property indicating that the property has been so designated. Sec. 42.104 - 42.125. Reserved. ARTICLE 4. REQUIREMENTS AND REGULATIONS Sec. 42.126. Promulgation Amendment of regulations. The historic preservation commission may from time to time promulgate, amend tl.1ld reseind recommend amendments to these regulations to the city council as the commission it may deem necessary to effectuate the purposes of this chapter. 5
