<br />on the establishment of the proposed district. thereon after due nNotice of the public hearing will be <br />published in a newspaper of general circulation in the city, 'v"vTIieh shall include and a written notice of <br />the public hearing: will be mailed to the owners of all properties to be included in the district at least ten <br />days before the hearing. <br /> <br />(d) After the public hearing the historic preservation commission shall submit a final report with <br />its recommendations and those of the planning and zoning commission and a draft of a proposed <br />ordinance to the city council for its action. <br /> <br />Sec. 42.102. Local Dgistricts and landmarks established. <br /> <br />There are established the following local historicttt districts within the corporate limits: <br /> <br />(1) The Belvin Street historicttt district. <br /> <br />(2) The San Antonio Street historicttt district. <br /> <br />(3) The Downtown historicttt district. <br /> <br />Sec. 42.103. Designation of local historic landmarks. <br /> <br />(a) There is ttre established the following: local historical landmarks within the corporate limits~ :- <br /> <br />The Oak Heights Live Oak Tree located in the 500 Block of Franklin Drive. <br /> <br />(b) Upon recommendation ofthe historic preservation commission and upon review by the planning <br />and zoning commission, the city council may, aftcr holding a public hcftfing preceded by giving <br />suffieient vvTitten notice to the oVvncrs tl.1ld occUf'ftnts of the affected propcrty flfid posting notice in its <br />nornutl lllflfi1ler, adopt an ordinance designating one or more local historic landmarks. Before adopting <br />the ordinance. the council will conduct a public hearing for which notice has been published in a <br />newspaper of general circulation in the city. and written notice sent to the owner of the proposed <br />landmark at least ten days before the hearing. The designation will be based on the following criteria: <br /> <br />(1) Historical, architectural and cultural significance;:- <br /> <br />(2) Suitability for preservation or restoration; and :- <br /> <br />(3) Educational value. <br /> <br />(c) In order for any property to be designated in the ordinance, it must in addition meet the criteria <br />established for inclusion of the property in the National register of Historic Places. <br /> <br />(d) Upon adoption of the ordinance, the owners and occupants of each designated local historic <br />landmark shall be given written notification of the designation by the city council. <br /> <br />(e) One copy of the ordinance shall be filed by the historic pfescrvation conlmission in the office <br />of the registrar of deeds of the county in which the property is located. <br /> <br />(f) The ordinance shall also provide for a suitable sign or marker on or near the property indicating <br />that the property has been so designated. <br /> <br />Sec. 42.104 - 42.125. Reserved. <br /> <br />ARTICLE 4. REQUIREMENTS AND REGULATIONS <br /> <br />Sec. 42.126. Promulgation Amendment of regulations. <br /> <br />The historic preservation commission may from time to time promulgate, amend tl.1ld reseind <br />recommend amendments to these regulations to the city council as the commission it may deem <br />necessary to effectuate the purposes of this chapter. <br /> <br />5 <br />
