<br />(c) A certificate of appropriateness is required for the activities described in subsection (a), whether <br />or not a building permit is required. <br /> <br />(d) For outdoor ad-.'crtising signs, the tcml "exterieJr featilfes" is construed to mean the style, <br />material, sizc and loeation of aU signs. <br /> <br />te1 @ The historic preservation commission shall not consider interior arrangement and shall take <br />no action under this section except for the purpose of preventing the construction, alteration, restoration, <br />moving or demolition of buildings, structures, appurtenant fixtures, outdoor ttdvertising signs or natural <br />features significant trees in f!: the historic district which would be incongruous with the historical, <br />architectural or cultural aspects of the district. <br /> <br />ft} W A certificate of appropriateness expires one year from the date it is issued if the approved work <br />has not commenced, and it expires two years from the date it is issued if the approved work has not been <br />completed. <br /> <br />Sec. 42.077. Application; hearing; issuance or denial. <br /> <br />(a) At least ten five days before the commission meeting at which a certificate of appropriateness <br />for a structure will be considered, written notice of the proposed certificate shall be sent by regular mail <br />to the owner of the structure, the applicant, and each owner of real property within 200 feet of the <br />property on which the structure is located, as indicated by the most recently approved tax roll. <br /> <br />(b) Vv'hen t The commission dcems it nccessttry, it may shall hold a public hearing concerning the <br />application. <br /> <br />(c) If the commission determines that the proposed construction, reconstruction, alteration, moving <br />or demolition is appropriate, it shall fortrn.vith approve the application and shall issue to the applicant <br />a certificate of appropriateness. <br /> <br />(d) If the commission determines that a certificate of appropriateness should not be issued, it shall <br />place upon its records the reasons for the determination and shall forth-.villi notify the applicant of the <br />determination, furnishing the applicant tlIl attested a copy of its reasons therefore and its <br />recommendations, if any, as appearing in the records of the commission. <br /> <br />(e) The commission may approve the application when the owner would suffer extreme hardship, <br />not including loss of profit, unless the certificate of appropriateness is were issued forth-.-.ith. <br /> <br />(t) Any applicant or interested person aggrieved by a ruling of the commission under this section <br />may, within 3B 10 days after the ruling, appeal to the zoning board of adjustments and appeals in written <br />form. The appeal will be heard by the zoning board of adiustments and appeals using the same standards <br />and criteria for determining the appropriateness of the proposed activity as are used by the commission. <br />The zoning board of adiustments and appeals shall conduct a public hearing prior to making its decision <br />on the appeal. notice of which shall be given in the manner described in subsection (a). <br /> <br />Secs. 42.078 - 42.100. Reserved. <br /> <br />ARTICLE 3. LOCAL HISTORIC DISTRICTS AND LANDMARKS <br /> <br />Sec. 42.101. Establishment oflocal historic districts. <br /> <br />(a) Local Hhistoric districts shall be established by ordinance. <br /> <br />(b) Before the establishment of a local historic district, the historic preservation commission shall <br />conduct studies and research and make a report on the historic significance of the exteriors of buildings, <br />structures, features, sites, objects and surroundings in the area of the proposed district city. The <br />commission report shall contain recommendations concerning the area to be included in the proposed <br />historic districts. <br /> <br />(c) Copies of the report shall be transmitted for review and recommendation to the planning and <br />zoning commission; and to the state historical commission and to thc 3t-ate m3torieal ad-v'isory eouncil. <br />Sixty days or more after the transmittal, the historic preservation commission shall hold a public hearing <br /> <br />4 <br />
