<br />Sec. 42.052. Organization. <br /> <br />(a) The appointed members of the historic preservation commission shall elect officers who shall <br />serve for terms of one year. <br /> <br />(b) The commission may establish any rules necessary for the orderly conduct of its business. <br /> <br />(c) All meetings of the commission shall be open to the public. <br /> <br />(d) The commission shall keep a record, which shall be open to public view, of its resolutions, <br />proceedings and actions. <br /> <br />Sec. 42.053. Terms of office. <br /> <br />(a) The sff seven members of the historic preservation commission appoiItted by the ei:ty cOUficil <br />shall serve three-year staggered terms, with the terms oftvv't} three members being appointed in January <br />of one year. two members appointed in January of the next year. and two members being appointed in <br />January of the following year expiring on. the date ofthe first rcgulM city couneil mceting in. Meetings; support staff. <br /> <br />(a) The historic preservation commission shall elect from its membership a chair who shall serve <br />for a term of one year and who shall be eligible for reelection. The chair shall preside over the <br />commission and shall have the right to vote. The 'commission shall hold regular monthly meetings at <br />a time and date established by the commission. Deadlines for filing applications for certificates of <br />appropriateness shall be determined by the commission. <br /> <br />(b) The director of planning and development services shall provide professional staff support to <br />the historic preservation commission.:. aftd The director or the director's designee shall attend all <br />meetings and workshops held by the commission. <br /> <br />Sec. 42.055. Injunctions <br /> <br />Wherever any person has engaged in or is about to engage in any act or practice which constitutes <br />or will constitute a violation of section 42.076,42.129 or 42.131, the historic preservation commission <br />may make a recommendation to city council that the city make application to the appropriate court for <br />an order enjoining an act or practice or requiring the person to refrain from the prospective violation or <br />to remedy the violation by restoring the affected property to its previous condition. <br /> <br />Secs. 42.056 - 42.075. Reserved. <br /> <br />DIVISION 3. CERTIFICATE OF <br />APPROPRIATENESS <br /> <br />Sec. 42.076. Required; conditions. <br /> <br />(a) Aftcr the designation elfIn a local historic district or at a local historic landmark, there shall be <br />no changes or alterations made. except for changes in color. to that portion of a structure's exterior that <br />is normally visible tel traffic passin.g the strcct eln. vvmch the strueturc fron.ts or sides, for a comer lot, <br />from any adiacent public street until a certificate of appropriateness has been approved by the historic <br />preservation commission. The term "structure" includes accessory buildings, roof3, vv'frlls, fences, light <br />fixtures, steps, pa'v"cment, gates, outdewr ad'v'crtisin.g signs and ether-appurtenant features. <br /> <br />(b) A certificate must be issued by the historic preservation commission prior to the issuance of a <br />building permit or other permit granted for purposes of constructing or altering structures. <br /> <br />3 <br />
