<br />133 <br /> <br />RESOLUTION 1999- 28 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING AN EXTENSION OF <br />THE CITY'S WATER SYSTEM TO THE UNIVERSITY <br />CHURCH OF CHRIST PROPERTY ON COUNTRY ESTATES <br />DRIVE; APPROVING AN AGREEMENT FOR THE <br />UNIVERSITY CHURCH OF CHRIST TO REIMBURSE THE <br />CITY FOR THE COST OF THE EXTENSION; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. City Code Section 86.003(c) requires City Council approval for the extension <br />of City water mains to serve uses outside the City limits. <br /> <br />2. The University Church of Christ (the "Owner") has requested permission to <br />extend a City water main to serve its property at 115 Country Estates Drive (the <br />"Property"), which is outside the city limits. <br /> <br />3. This water main extension appears to be feasible and is to be constructed <br />as a part of the City's Northwest Water System Improvements Project, at the sole expense <br />of the Owner under the attached reimbursement agreement with the City. <br /> <br />4. The City Council is willing to approve this request on the express condition <br />that the Owner, on behalf of itself, its successors and assigns, consents to the annexation <br />of the Property at such time as it is adjacent to the City limits. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. An extension of the City's water system to serve the Property is approved, <br />subject to the express condition that the Owner, on behalf of itself, its successors and <br />assigns, consents to the annexation of the Property at such time as it is adjacent to the City <br />limits. <br /> <br />PART 2. The Reimbursement Agreement attached to this resolution between the <br />City and the University Church of Christ for reimbursement by the University Church of <br />Christ of the cost of extending a City water main to the Property is approved, and"the City <br />Manager, Larry D. Gilley, is authorized to execute the agreement on behalf of the City. <br /> <br />PART 3. This Resolution shall be in full force and effect from and after its passage. <br /> <br />ADOPTED this 8th day of February , 1999. <br /> <br />~' tte t.
