<br />134 <br /> <br />REIMBURSEMENT AGREEMENT FOR <br />WATER LINE EXTENSION <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />This Agreement is made on this 9th day of February , 1999 between the City <br />of San Marcos, a Texas municipal corporation (the "City"), and the University Church of <br />Christ (the "Church"). <br /> <br />RECITALS <br /> <br />1. The City is in the process of constructing the Northwest Water System <br />Improvements Project (the "Project"), which includes the construction of a new City water <br />main along Ranch Road 12 west of the City. <br />2. The Church has requested that the City construct a water main extension (the <br />"Extension") from Ranch Road 12 to the Church's property at 115 Country Estates Drive, <br />with the Church to reimburse the City for the full cost of the Extension. <br />3. The City is willing to include the construction of the Extension in the Project, with <br />the full cost of the Extension to be paid by the Church. <br /> <br />AGREEMENT <br />The City and the Church, in consideration of the mutual promises, covenants and <br />agreements set forth in this Agreement, agree and contract as follows: <br /> <br />1. The City agrees to include the construction of the Extension as a part of the <br />Project, as described on the City's construction plans for the Project. <br /> <br />2. The Church agrees to pay to the City $11,451.00, being the full cost of the <br />Extension, within ten days of the City's delivery to the Church of an invoice for this amount <br />upon substantial completion of the Extension. <br /> <br />3. This Agreement and the provision of water service through the Extension are <br />subject to all valid and applicable ordinances, rates, rules, regulations, and laws of all <br />governmental agencies having lawful jurisdiction over them. <br /> <br />4. This Agreement constitutes the entire agreement between the parties, and may <br />be amended only by a written document signed by the parties. This Agreement shall be <br />binding upon the heirs, administrators, successors and assigns of the parties. The <br />
