134 REIMBURSEMENT AGREEMENT FOR WATER LINE EXTENSION STATE OF TEXAS COUNTY OF HAYS This Agreement is made on this 9th day of February , 1999 between the City of San Marcos, a Texas municipal corporation (the "City"), and the University Church of Christ (the "Church"). RECITALS 1. The City is in the process of constructing the Northwest Water System Improvements Project (the "Project"), which includes the construction of a new City water main along Ranch Road 12 west of the City. 2. The Church has requested that the City construct a water main extension (the "Extension") from Ranch Road 12 to the Church's property at 115 Country Estates Drive, with the Church to reimburse the City for the full cost of the Extension. 3. The City is willing to include the construction of the Extension in the Project, with the full cost of the Extension to be paid by the Church. AGREEMENT The City and the Church, in consideration of the mutual promises, covenants and agreements set forth in this Agreement, agree and contract as follows: 1. The City agrees to include the construction of the Extension as a part of the Project, as described on the City's construction plans for the Project. 2. The Church agrees to pay to the City $11,451.00, being the full cost of the Extension, within ten days of the City's delivery to the Church of an invoice for this amount upon substantial completion of the Extension. 3. This Agreement and the provision of water service through the Extension are subject to all valid and applicable ordinances, rates, rules, regulations, and laws of all governmental agencies having lawful jurisdiction over them. 4. This Agreement constitutes the entire agreement between the parties, and may be amended only by a written document signed by the parties. This Agreement shall be binding upon the heirs, administrators, successors and assigns of the parties. The
