<br />2.2(g) of the Interlocal Agreement. It shall be considered conclusive evidence that the <br />RWRDG participants' primary purpose is other than to acquire groundwater withdrawal <br />rights if the value of the groundwater withdrawal rights are less than one third the total <br />price paid for the non-agricultural land. <br /> <br />Section 26. Consultants and Legal Advisor <br /> <br />The Management Council may from time to time direct the Administrator to retain <br />consultants, the cost of which shall be paid from the RWRDG operating fund if the <br />Management Council determines the services will benefit the R WRDG participants <br />generally. The cost of services which the Management Council determines will benefit <br />only certain RWRDG participants, will be collected from such participants in proportion <br />to their outstanding orders. The legal advisor and General Counsel to the R WRDG shall <br />be the San Antonio Water System Legal Department which shall act without <br />compensation. <br /> <br />Section 27. Compensation of Agent <br /> <br />Agent shall serve without compensation; however, the Management Council may by <br />majority vote reimburse Agent for extraordinary expenses, if any, incurred in connection <br />with the performance of its duties herein. Agent shall be reimbursed for all fees and <br />related expenses, including, but not limited to, title searches, title policies, surveys, <br />environmental due diligence, recordation fees, taxes, attorneys fees, necessary to carry <br />out Agent's duties under the ROPES and the Interlocal Agreement. <br /> <br />Section 28. Standby Option Program <br /> <br />The Management Council may in the future direct the Administrator and Agent to <br />acquire options to lease agricultural groundwater withdrawal rights for utilization in <br />critical periods. Participation in the standby option program by individual R WRDG <br />participants shall at all times be voluntary. <br /> <br />Section 29. Standby Irrigation Suspension Program <br /> <br />The Management Council may in the future direct the Administrator and Agent to <br />establish an irrigation suspension program in which agricultural irrigators are paid not to <br />irrigate their lands during critical periods. Participation in the irrigation suspension <br />program by individual RWRDG participants shall at all times be voluntary. <br /> <br />Section 30. Critical Period <br /> <br />R WRDG participants which determine they have excess Edwards Aquifer groundwater <br />withdrawal rights available during critical periods shall offer that water for sale or lease <br />to other RWRDG participants prior to offering that water for sale or lease to other users. <br />Such intraRWRDG transfers during critical periods may take place outside the <br />procedures and rules otherwise established by these ROPES.
