<br />I <br /> <br />I <br /> <br />I <br /> <br />14. <br /> <br />PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br /> <br />This Agreement is made this the 19th day of April , 2006, between the City <br />of San Marcos, Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and Klotz <br />Associates, Inc., 901 South Mopac Expressway, Building 5, Suite 220, Austin, Texas 78746 <br />("Engineer") for the provision of services in connection with the 2005 Neighborhood Sidewalks <br />Proj ect Phase (the "Proj ect"). <br /> <br />The City and the Engineer agree as follows: <br /> <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br /> <br />1.1 STANDARDS OF PERFORMANCE <br /> <br />1.1.1 Engineer will be responsible for the proper, accurate and adequate design and preparation <br />of plans and specifications and other construction contract documents and for construction <br />administration of the Project. The Project will be constructed in three separate phases to include <br />approximately ~ mile of sidewalk improvements along the east side of Staples Road from <br />Tampico to Durango Streets (Phase 1), approximately ~ mile of sidewalk improvements along <br />the west side of South Guadalupe Street between Grove Street and 228 South Guadalupe Street <br />(Tuttle Lumber Parking Lot) (Phase 2) and bridge foundations on the north side of East Hopkins <br />Street across the San Marcos River (Phase 3). It is anticipated that the City will proceed with <br />construction of the Project under three separate construction contracts beginning with Phase] <br />and proceeding to Phase 2. The Engineer will complete design phase services for Phase 3 but it <br />has not yet been determined whether the City will proceed with the construction of Phase 3 <br />Construction administration services for Phase 3 are delineated in this Agreement, but the <br />Engineer understands that it will not proceed with those services without written authonzatlOn <br />from the City. The Engineer will provide an estimate of fees for City approval prior to InItIating <br />Phase 3 construction administration services. Upon City's approval the Engineer's fees for these <br />services will be included in accordance with Section 1.5 of this Agreement. Funding for the <br />construction of this Project is being provided by the United States Department of Housing and <br />Urban Development ("HUD") through the Community Development Block Grant ("CDBG") <br />Program. The Engineer will perform all of its services so that the Project will proceed in <br />accordance with HUD guidelines. <br /> <br />1.1.2 The Engineer's Basic Services consist of the services described in Sections 1.1 through 1.4 <br />and include normal civil engineering services as well as those engineering services to be <br />performed through the following consulting disciplines as subcontractors to the Engineer: <br /> <br />(1) Byrn and Associates-Surveying <br />(2) Kleinfelder- Geotechnical <br />(3) Hicks and Company - Environmental <br /> <br />1.1.3 The performance of all services by the Engineer in connection with this Agreement wIll <br /> <br />Klotz Engineering <br /> <br />1 <br />
