<br />I <br /> <br />I <br /> <br />I <br /> <br />be by persons appropriately licensed or registered under State, local and Federal laws governing <br />their respective consulting disciplines. In performing all services under this Agreement, the <br />Engineer will use that degree of care and skill ordinarily exercised for similar projects by <br />professional Engineers who possess special expertise in the types of services involved under this <br />Agreement. <br /> <br />1.1.4 No work under this Agreement will be subcontracted by the Engineer without prior <br />written approval from the City. Any work or services subcontracted under this Agreement shall <br />be specified by separate written Agreement and shall be subject to each provision of this <br />Agreement. <br /> <br />1.1.5 Any provisions in this Agreement pertammg to the City's review, approval and/or <br />acceptance of written materials prepared by the Engineer and/or its subconsultants, contractors, <br />and subcontractors in connection with this Agreement will not diminish the Engineer's <br />responsibility for the materials. <br /> <br />1.1.6 Engineer will perform all of its services in coordination with the City. The Engineer will <br />advise the City of data and information the Engineer needs to perform its services, and the <br />Engineer will meet with City representatives at mutually convenient times to assemble this data <br />and information. <br /> <br />1.2 TASK 1 - PRELIMINARY ENGINEERING <br /> <br />For each Phase of the Project, the Engineer will: <br /> <br />1.2.1 Site Visit - Perform an initial site visit at each location with the City's Project Manager, a <br />Texas Department of Transportation ("TxDOT") representative (sidewalk projects only), a <br />Registered Accessibility Specialist (sidewalk projects only), and any other approved <br />sub consultants as necessary to obtain a clear picture of the anticipated improvements. This site <br />visit may also include representatives from utility companies and/or Union Pacific Railroad (UP) <br />at the City's request. The Engineer will arrange for field marking of utilities prior to the site <br />visit, if possible. <br /> <br />1.2.2 Pedestnan Bridge Selection - Review available prefabricated pedestrian bridges and <br />provide a summary letter to the City that identifies up to three alternatives of Bridges, discusses <br />the advantages and disadvantages of each, and provides a recommendation for review and <br />approval. The selected alternative consists of an 8-10' wide trussed pedestrian bridge capable of <br />spanning the existing flood plain with no intermediate bridge supports (bents) within the flood <br />plain. Therefore, the Engineer's estimated level of effort does not include any drainage <br />modeling effort, environmental effort, geotechnical effort or other effort for work within the <br />flood plain or sensitive environmental areas. <br /> <br />1.2.3 Preliminary Engineering Report ("PER") - Prepare letter reports for Phase I and Phase 2 <br />that identify the specific tasks required at each location, including the final scope of surveys, <br />geotechnical investigations, environmental permitting, Union Pacific Railroad ("UP") approvals, <br />Klotz Engineering <br /> <br />2 <br />
