The Engineer will be responsible for the submission of all plans and specifications <br />for the construction of this Project to the Texas Department of Licensing and Regulation for <br />review and approval prior to the time construction is set to begin in conformance with the <br />Architectural Barriers Act. The costs associated with the submission of plans for review under <br />the Architectural Barriers Act will be paid by the City. <br /> <br />1.3.9 Ensure that no reports, maps, or other documents produced in whole or in part under this <br />Agreement shall be the subject of an application for copyright by or on behalf of the Engineer. <br /> <br />1.3.10 Obtain approval from the City of all technical plans and specifications necessary for <br />successful completion of the Project prior to allowing the construction contract to be let for bid. <br /> <br />1.3.11 Prepare and provide the City with an updated cost estimate at each submittal stage. <br /> <br />1.3.12 Conduct up to three meetings in San Marcos during the Design Phase for each section of <br />the Project (nine meetings total), these meetings include public meetings, Project progress <br />meetings, City Transportation Advisory Board and Parks Board meetings. The Engineer will <br />provide visual displays as requested for these meetings. <br /> <br />1.3.13 Submit design plans to, and follow up with the appropriate utility companies to resolve <br />any anticipated conflicts. The Engineer anticipates that engineering for utility relocations will <br />be performed by or through the specific utility providers. <br /> <br />1.3.14 Assist the City in connection with the City's responsibility for filing documents required <br />for the approval of governmental authorities having jurisdiction over the Project including the <br />submission of final plans to TxDOT as required for approvals and permits (sidewalk projects <br />only). The Engineer is responsible only for the preparation of a Multiple Use Agreement or a <br />notification under an existing Municipal Maintenance Agreement, if appropriate. Furthermore, <br />the Engineer will submit final plans to UP as required for approvals and permits (Phase 2 only). <br />Both parties understand that the required effort to obtain UP permitting/approval varies greatly <br />from project to project, the Engineer has included a reasonable allowance for this effort of <br />$2,000.00. The Engineer will diligently pursue such permits/approvals within the allowance, and <br />will not exceed the allowance without obtaining approval from the City. <br /> <br />1.3.15 Make review/final submittals to the City at the following stages (one copy of each item): <br /> <br />Klotz Engineering <br /> <br />5 <br />
