99. <br /> <br />PROFESSIONAL SERVICES AGREEMENT <br /> <br /> This AGREEMENT is made this the 25th day of February ., 2003, between the City <br />of Sar Marcos, Texas, ("City"), 630 E. Hopkins, San Marcos, Texas 78666 and Post, Buckley, <br />Schuh & Jernigan, Inc. d/b/a/PBS&J ("Engineer") 206 Wild Basin Road, Suite 300, Austin, Texas <br />78746, for the provision of professional engineering services in connection with a Wastewater <br />Master Plan ±hr the City. <br /> <br />The City and the Engineer agree as follows: <br /> <br /> ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br /> <br />1.1 STANDARDS OF PERFORMANCE <br /> <br />1. l. 1 Engineer will be responsible for the proper, accurate and adequate design and preparation of <br />a Wastewater Master Plan for the City and its two-mile extraterritorial jurisdiction, to include data <br />collection, flow monitoring, hydraulic modeling, analysis, and wastewater improvement <br />recommendations. <br /> <br />1.1.2 The Engineer's Basic Services consist of the services described in Sections 1.1 tl~'ough 1.4 <br />and includes normal civil engineering services. The Basic Services contained in ttfis contract are the <br />first phase of services. Additional services will be submitted for approval by the City after <br />completion of the first phase of services. If approved, the remaining services will be added to this <br />agreement as an amendment. Certain portions of the Engineer's Services may require to be <br />performed through the following consulting disciplines as subcontractors to the Engineer: <br /> <br />(1) GSWW, Inc.- Flow Monitoring <br /> <br />1.1.3 The performance of all services by the Engineer in connection with this Agreement will be <br />by or under the direct supervision of persons appropriately licensed or registered under State, local <br />and Federal laws governing their respective consulting disciplines. In performing ail services trader <br />this Agreement, the Engineer will use that degree of care and skill ordinarily exercised for similar <br />projects by professional Engineers who possess special expertise in the types of services involved <br />under this Agreement. <br /> <br />1.1.4 No work m~der this Agreement will be subcontracted by the Engineer without prior wa'itten <br />approval from the City. Any work or services subcontracted trader this Agreement shall be specified <br />by separate written Agreement and shall be subject to each provision of this Agreement. <br /> <br />1.1.5 Any provision in this Agreement pertaining to the City's review, approval and/or acceptance <br />of written materials prepared by Engineer and/or its sub-consultants, contractors, and subcontractors <br />in connection with this Agreement will not diminish Engineer's responsibility for the materials. <br /> <br />PBS&J.wpd I <br /> <br /> <br />
