<br />I <br /> <br />I <br /> <br />I <br /> <br />8 <br /> <br />regular meeting <br /> <br />january 14, 1980 <br /> <br />page five <br /> <br />The Mayor opened a Public Hearing to consider amendment of the <br />zoning Ordinance to broaden the definition of "family" to include <br />individuals related by adoption and marriage. No opposition was <br />presented. The Mayor closed the hearing and the City Secretary <br />read the Ordinance having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, <br />TEXAS, AMENDING SECTION 4, ENTITLED "DEFINITIONS" OF <br />APPENDIX A, ENTITLED "GENERAL ZONING ORDINANCE" OF THE <br />CODE OF ORDINANCES OF SAID CITY; BY CHANGING THE DEFINITION <br />OF "FAMILY" TO INCLUDE ANY NUMBER OF INDIVIDUALS LIVING <br />TOGETHER AS A SINGLE HOUSEKEEPING UNIT, IN WHICH NOT MORE <br />THAN TWO 92) INDIVIDUALS ARE UNRELATED BY .MARRIAGE OR <br />LEGAL ADOPTION WITHIN THE DEFINITION, BY ALPHABETIZING SAID <br />DEFINITIONS AND DECLARING AN EMERGENCY. <br /> <br />Mr. Hyatt moved the Ordinance be adopted as an emergency. <br />Mr. Breihan seconded the motion, which passed unanimously. <br /> <br />The City Secretary read an Ordinance having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ABANDINING PORTIONS OF GUADALUPE STREET, ROANOAK STREET, <br />LYNDON B. JOHNSON DRIVE, PLEASANT STREET, PARK STREET, AND A <br />PORTION OF AN ALLEY EXTENDING NORTHWARD AND EASTWARD FROM <br />PLEASANT STREET AND SESSOM DRIVE LOCATED WITHIN THE CORPORATE <br />LIMITS OF SAID CITY; PROVIDING FOR THE REVERSION OF THE FEE <br />IN SAID LAND AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Cavazos moved the Ordinance be approved on first reading. <br />Mr. James seconded the motion. Eugene Payne, representing South- <br />west Texas State University, appeared before the Council to report <br />that the abandonment of the property would resolve conflicts <br />regarding which agencies should maintain and patrol the streets <br />inside the SWTSU campus. Mr. Hyatt objected to the University <br />closing L.B.J. Drive to through traffic or other streets on campus <br />since persons living above the University campus had difficulty <br />in traveling from their homes to the other side of the City. <br />The motion to approve the Ordinance on first reading was unanimously <br />adopted. <br /> <br />The Mayor read the caption of an Ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, &~ENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING <br />OF .431 ACRES OF LAND OUT OF THE T.J. CHAMBERS SURVEY, LOCATED <br />IN THE 1200 BLOCK OF NORTH L.B.J. DRIVE, FROM "R-l" (SINGLE <br />FAMILY RESIDENTIAL) TO "D" (MULTIFAMILY). <br /> <br />Mr. Breihan moved the Ordinance be adopted on third and final <br />reading. Mr. James seconded the motion, which passed unanimously. <br /> <br />The Mayor introduced for consideration approval of a Section 8 <br />Housing Construction Project to be located near the Intersection <br />of Loop 82 and I.H. 35 North. Council Member Ted Breihan left his <br />seat at the Council table after explaining that he had a personal <br />financial interest in the property to be sold to the developer <br />of the proposed housing construction project. Mr. Hyatt moved <br />the project be approved as presented. Mr. James seconded the motion. <br />Mr. Cavazos stated that he was in favor of approving the project <br />with the stipulation that the Department of Housing and Urban <br />Development be informed that hte location was near the City sewer <br />treatment plant and with the understanding that the Department of <br />Housing and Urban Development would not obligate the City to relocate <br />the plant due to its proximity to the housing site sooner than the <br />deadline to be established by the City in its utility improvement <br />program. Mr. Tenorio stated that he objected to approving the <br />site since it was not located in a district approved by the Housing <br />Assistance Plan. Mrs. James A. Moore appeared before the Council <br />to encourage them to find a better site out of the flood plain area. <br />Developer Stan Smith pointed out that construction of the housing <br />units would be elevated above the flood plain level.
