<br />7 <br /> <br />regular meeting <br /> <br />january 14, 1980 <br /> <br />page four <br /> <br />The Mayor opened a Public Hearing to consider a request for <br />a change in the zoning of a 1 acre tract out of the T.W. <br />Forsyth Survey, located at the corner of Ranch Road 12 and <br />the entrance to Country Estates Subdivision, from "R-l" to <br />"C". Mr. J.B. Millican appeared before the Council to request <br />the zoning change. No opposition was presented. Mr. Millican <br />said that he intended to use a septic tank on the property and <br />a private well. Mr. Tenorio said he felt the City should extend <br />water and sewer service to the area since the extension of <br />service to the San Marcos Baptist Academy would stimulate growth <br />in the area. He also asked if the City had an ordinance relating <br />to private water wells and asked that research be done on the <br />question. Following the Public Hearing, the City Secretary read <br />the ordinance having the following caption: <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE ~~ICH <br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY <br />CHANGING THE ZONING OF APPROXIr1ATELY 1 ACRE OUT OF THE <br />T.W. FORSYTH SURVEY, LOCATED AT THE CORNER OF RANCH ROAD <br />12 AND THE ENTRANCE TO COUNTRY ESTATES, FROM "R-l" (SINGLE <br />FAMILY RESIDENTIAL) TO "c" (COMMERCIAL). <br /> <br />Mr. Cavazos moved the Ordinance be approved on first reading. <br />Mr. Hyatt seconded the motion, which passed unanimously. <br /> <br />The Mayor introduced an Ordinance changing the zoning of part <br />of Lots 2 and 3 of Block 15 of the Lindsey and Harvey Addition <br />and part of Lot 4 of Block 6 of the Mountain City Addition, from <br />"P" to "D" and opened a Public Hearing to consider the question. <br />Ken Krause, applicant, was present to make the request, stating <br />that the property was at one time owned by San Marcos Baptist <br />Academy and that he wished to change the zoning to reflect the <br />present use of the property. No opposition was presented. The <br />Mayor closed the hearing and the City Secretary read the ordinance <br />having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED ~ffiY 23, 1966 (VOL. 32) BY CHANGING THE <br />ZONING OF PART OF LOTS 2 AND 3 OF BLOCK 15 OF THE LINDSEY <br />AND HARVEY ADDITION AND PART OF LOT 4 OF BLOCK 6 OF THE <br />MOUNTAIN CITY ADDITION, LOCATED AT 501 ACADEMY, FROM "P" <br />(PUBLIC) TO "D" (MULTIFAMILY). <br /> <br />I <br /> <br />Mr. Breihan moved the Ordinance be approved on first reading. <br />Mr. Tenorio seconded the motion, which passed unanimously. <br /> <br />The Mayor opened a Public Hearing to consider a request for the <br />rezoning of Lots 430 and 431 of Block 20 of the Westover Addition <br />from "R-l" (single family residential) to "R-2" (duplex). The <br />applicant, Ralph Ramirez, was not present at the meeting and had <br />informed the City Secretary that he was requesting postponement <br />of consideration until the next meeting when he could appear. The <br />Mayor reported that the hearing would be held as scheduled. <br />Present to object to the rezoning \vere Robert McKinney, Billy <br />Moore and Joe Cox, saying they were opposed to the higher density <br />land use in the neighborhood. The Mayor stated that the hearing <br />would be continued at the next meeting of the Council. The City I <br />Manager reported that the Oak Heights traffic study requested by <br />residents of the area would be a high priority item in the Master <br />Plan program, and pointed out that the staff recommendations for <br />rezoning of the property was based on the fact that other property <br />in the neighborhood was already zoned for duplex use. <br />
