Mr. Kraus explained that the <br />zoning change would bring the zoning into conformity with the current <br />usage of the property. Mr. Conway Wharton made a statement to <br />Council and explained his reasons for opposing the zoning change. <br />Joe Garza informed the Council that a petition submitted just prior <br />to the meeting by Rev. Wharton represented approximately 19% of <br />the property within 200' of the subject property. Ken Long also <br />appeared before Council to state his objections to the zoning change. <br />Joe Garza read the staff comments on this proposed zoning change to <br />the Council. Mr. Tenorio asked about the problem of low water pressure <br />in the area. He asked that staff report at the next meeting about <br />any problems, if any, with water and sewer in this area. The Mayor <br />closed the hearing and the City Secretary read the Ordinance in its <br />entirety. Mr. James moved the Ordinance be approved on first reading. <br />Mr. Breihan seconded the motion. On roll call, the following vote <br />was recorded: <br /> <br />AYE: Breihan, Hansen, James, Tenorio <br /> <br />NAY: Cavazos, Sutton <br /> <br />The Mayor introduced for consideration a request by Gary Hamilton <br />for a temporary permit to locate a mobile home on Lots 13 & 14, <br />Block 2 of the Westover Addition, 1403 Franklin Drive. Mr. Tenorio moved <br />to approve the permit. Mr. James seconded the motion. Joe Garza <br />informed the Council that the Planning & Zoning Commission recommended <br />approval of the request, but that the staff had questions concerning <br />interpretation of the zoning ordinance. Mr. Garza explained that <br />there were already 2 mobile homes placed across the common line of <br />Lots 13 & 14. The City Manager suggested that the Council might <br />wish to table this request until staff obtained a clear definition <br />of a trailer park. Mr. Tenorio withdrew his motion and moved to <br />table the request until the next meeting. Mr. James seconded the <br />motion. On roll call, the following vote was recorded: <br /> <br />AYE: Cavazos, Hansen, James, Sutton, Tenorio <br /> <br />NAY: Breihan <br /> <br />The Mayor introduced for consideration a request by Geronimo <br />Rodriguez for a temporary permit to place a mobile home on Lots <br />6 & 7, Block 10, Victory Gardens 1st Addition, 319 Roosevelt St. <br />Mr. Cavazos moved the permit be approved. Mr. Tenorio seconded <br />the motion which passed unanimously. <br /> <br />The Mayor introduced for consideration a request by Germana Juares for <br />a temporary permit to locate a mobile home on Lot 3, South End Addition, <br />104 Gomez St. Mr. Tenorio moved the permit be approved. Mr. Cavazos <br />seconded the motion which passed unanimously. <br /> <br />The Mayor introduced for consideration a request by Anita Jo Wright <br />for a temporary permit to locate a mobile home on part of Lots <br />5 & 6, Block 8, D. S. Combs Addition, 315 Herndon. Mr. Sutton moved <br />the permit be approved. Mr. Cavazos seconded the motion which passed <br />unanimously. <br /> <br />The Mayor introduced for consideration an Ordinance on emergency <br />having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, ACCEPTING THE BID <br />OF RUPERTO RIVERA FOR THE PURCHASE OF LOTS <br />3 AND 4 OF BLOCK 15 OF THE VICTORY GARDENS <br />ADDITION #1 TO THE CITY OF SAN MARCOS, TEXAS, <br />SAID ADDITION BEING RECORDED IN VOLUME 129 <br />AND PAGE 559 OF THE HAYS COUNTY DEED RECORDS, <br />AUTHORIZING THE MAYOR TO EXECUTE A SPECIAL <br />WARRANTY DEED TO SAID BIDDER ON BEHALF OF THE <br />CITY OF SAN MARCOS, IN TRUST, FOR ITSELF, THE <br />STATE OF TEXAS, THE COUNTY OF HAYS, AND THE <br />SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL <br />DISTRICT; AND DECLARING AN EMERGENCY. <br />
