<br />50 <br /> <br />regular meeting, february 25, 1980 <br /> <br />page two <br /> <br />Chris Brasher also came before the Council to state that citizens <br />have paid taxes on these streets for years and pointed out the <br />traffic problems created by the closing of these streets. Arnold <br />Leder spoke to the Council about the impact of this action on the <br />Holland Area Neighborhood. He asked that the Council not pass the <br />Ordinance on final reading until the Master Plan Committee could <br />study it further. Mr. Tenorio asked if the University would be <br />willing to wait until the closing could be studied by the Committee <br />as recommended by Mr. Leder. Dr. Payne informed Council that the <br />University would prefer immediate action. He also said that the <br />University had not made plans for use of the property. The City <br />Manager stated that this issue had been under careful consideration <br />for a great length of time and that development of the University <br />campus had made use of Guadalupe Street and L.B.J. Drive undesirable <br />as major thoroughfares. He recommended the Council adopt the <br />Ordinance. Mr. Breihan moved to adopt the Ordinance on third and <br />final reading. Mr. Cavazos seconded the motion. On roll call, the <br />following vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Breihan, Cavazos, Hansen, James, Sutton <br />Tenorio. <br /> <br />The Mayor introduced for consideration an Ordinance on third and final <br />reading having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES, <br />AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING <br />OF MOCKINGBIRD HILL ANNEX NUMBER ONE, LOCATED ON REDWOOD ROAD, <br />FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "D" (MULTIFAMILY). <br /> <br />Mr. Breihan moved to adopt the Ordinance. Mr. Tenorio seconded the <br />motion, which passed unanimously. <br /> <br />The Mayor introduced for consideration an Ordinance having the <br />following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES, <br />AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING <br />OF A TRACT OF LAND OUT OF THE T.J. CHAMBERS SURVEY, LOCATED AT <br />121 LAMAR AND 1225 NORTH L.B.J. DRIVE FROM "R-l" (SINGLE <br />FAMILY RESIDENTIAL) TO "D" (MULTIFAMILY). <br /> <br />Barbara Edwards, City Attorney, stated that owners of more than 20% <br />of the property within 200' had filed a written protest to the zoning <br />change and that an affirmative vote of three-fourths of the Council <br />would be necessary to approve the Ordinance. Since this did not <br />happen on first reading on February 11, the issue should be considered <br />closed and the Ordinance not approved. Ms. Edwards' opinion is <br />attached and made a part of these Minutes. <br /> <br />The Mayor introduced for consideration a request by Gary Hamilton <br />for a temporary permit to locate a mobile home on Lots 13 and 14, Block <br />2 of the Westover Addition, 1403 Franklin Drive. The City Attorney <br />stated that approval of this permit would constitute a mobile home <br />park since there were already two mobile homes on the tract. <br />Mr. Sutton moved to deny the request. Mr. Tenorio seconded the motion, <br />which passed unanimously. <br /> <br />The Mayor introduced for consideration a request by Rita Lucio for <br />a temporary permit to locate a mobile home on part of Lot 29, Block <br />Four of the Benito Cruz Partition, 416 Saltillo Street. Mr. Cavazos <br />moved to approve the request. Mr. James seconded the motion, which <br />passed unanimously. <br /> <br />The Mayor introduced for consideration a REsolution having the follow- <br />ing caption: <br /> <br />A RESOLUTION APPROVING AMENDED BY LAWS OF THE CITY OF <br />SAN MARCOS INDUSTRIAL DEVELOPMENT CORPORATION. <br /> <br />Mr. James moved to approve the Resolution.
