If the Consultant develops all or any portion of the Design Phase and the City elects to modify the project, then the Consultant shall be paid for that portion of the Design Phase only previously approved which has been completed by the Consultant at a mutually agreed amount. The new Design Phase based on the modification shall then be performed in accordance with the fee provided under "Fee Schedu1e" and the percentage allocations as set forth in this Appendix. B. Services Not Included in Above Fee The fees as described above for the Preliminary, Design and Construction Phases of the proj ect sha 11 provi de compensati on to the Consultant for all services called for under this agreement to be performed by him or under his direction except the services set forth below. These excluded services and the compensation being paid by the City to the Consultant for their performance when authorized in writing by the Director of Public Works are set forth as follows: Send ce Basis of Compensation (1) Additional copies of reports, and additional blueprint copies of drawings and specifications over ten unless otherwise agreed. Direct costs at standard reproduc- tion cost. (2) Assistance to the City as expert witness in any litigation with third parties, arising from the development or construction of the project. $300.00 per diem for each day in which Consultant's presence is re- quired by City. (3) Any extra services not included in contract but authorized by City in writing. To be agreed upon in writing.
