<br />I <br /> <br />I <br /> <br />- <br /> <br />6. OWNERSHIP OF DOCUMENTS <br /> <br />All documents developed under this contract including notes, <br />data, studies, drawings, surveys, maps, models, photographs <br />and reports shall be the property of the CONSULTANT. Upon <br />completion of Phase I, and final payment specified in Section <br />3, those documents shall be turned over to the CITY and become <br />CITY property. <br /> <br />During the progress of the program, the CITY shall have full <br />access to the work in progress. Such access shall be at <br />the CONSULTANT'S principal office in Austin, Texas, or <br />CONSULTANT will provide CITY with one copy of work to remain <br />property of CONSULTANT. <br /> <br />7. The CONSULTANT will not discriminate against any employee <br />or applicant for employment because of race, color, religion, <br />sex or national origin. The CONSULTANT shall take affir- <br />mative action to ensure that applicants are employed and that <br />employees are treated during employment, without regard to <br />their race, color, religion, sex or national origin. Such <br />action shall include, but not be limited to the following: <br />Employment, upgrading, demotions or transfers, recruitment or <br />recruitment advertising; layoffs or termination; rates of <br />payor other forms of compensation; selection for training <br />including apprenticeship; and participation in recreational <br />and educational activities. The CONSULTANT agrees to post <br />in conspicuous places, available to employees and applicants <br />for employment, notices to be provided by the Government <br />setting forth the provisions of this nondiscrimination clause. <br />The CONSULTANT will in all soliciations or advertisements <br />for employees placed by or on behalf of the CONSULTANT, state <br />that all qualified applicants will receive consideration for <br />employment without regard to race, color, religion, sex, or <br />national origin. The CONSULTANT will cause the foregoing <br />provisions to be inserted in all subcontracts for any work <br />covered by this contract so that such provisions will be <br />binding on each subcontractor; provided tr-at the foregoing <br />provisions shall not apply to contracts or subcontracts for <br />standard commercial supplies or raw materials. The CONSULTANT <br />shall keep such records and submit such reports concerning <br />the racial and ethnic origin of applications for employment <br />and employees as the CITY may require. The CONSULTANT <br />agrees to comply with such rules, regulations or guidelines <br />as the CITY may issue to implement these requirements. <br />CONSULTANT further agrees to comply with all State and Federal <br />Statutes, Presidential Orders, and regulations issued by <br />valid government authority, whether hereinabove mentioned or <br />not, applicable to this contract and the work to be performed <br />under it. <br /> <br />8. No officer, member, or employee of the CITY and no members of <br />its governing body, and no other public official of the govern- <br />ing body of ~he locality or localities in which the project is <br /> <br />-4- <br />
