I I - 6. OWNERSHIP OF DOCUMENTS All documents developed under this contract including notes, data, studies, drawings, surveys, maps, models, photographs and reports shall be the property of the CONSULTANT. Upon completion of Phase I, and final payment specified in Section 3, those documents shall be turned over to the CITY and become CITY property. During the progress of the program, the CITY shall have full access to the work in progress. Such access shall be at the CONSULTANT'S principal office in Austin, Texas, or CONSULTANT will provide CITY with one copy of work to remain property of CONSULTANT. 7. The CONSULTANT will not discriminate against any employee or applicant for employment because of race, color, religion, sex or national origin. The CONSULTANT shall take affir- mative action to ensure that applicants are employed and that employees are treated during employment, without regard to their race, color, religion, sex or national origin. Such action shall include, but not be limited to the following: Employment, upgrading, demotions or transfers, recruitment or recruitment advertising; layoffs or termination; rates of payor other forms of compensation; selection for training including apprenticeship; and participation in recreational and educational activities. The CONSULTANT agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the Government setting forth the provisions of this nondiscrimination clause. The CONSULTANT will in all soliciations or advertisements for employees placed by or on behalf of the CONSULTANT, state that all qualified applicants will receive consideration for employment without regard to race, color, religion, sex, or national origin. The CONSULTANT will cause the foregoing provisions to be inserted in all subcontracts for any work covered by this contract so that such provisions will be binding on each subcontractor; provided tr-at the foregoing provisions shall not apply to contracts or subcontracts for standard commercial supplies or raw materials. The CONSULTANT shall keep such records and submit such reports concerning the racial and ethnic origin of applications for employment and employees as the CITY may require. The CONSULTANT agrees to comply with such rules, regulations or guidelines as the CITY may issue to implement these requirements. CONSULTANT further agrees to comply with all State and Federal Statutes, Presidential Orders, and regulations issued by valid government authority, whether hereinabove mentioned or not, applicable to this contract and the work to be performed under it. 8. No officer, member, or employee of the CITY and no members of its governing body, and no other public official of the govern- ing body of ~he locality or localities in which the project is -4-
