<br />I <br /> <br />I <br /> <br />- <br /> <br />. <br /> <br />situated or being carried out who exercises any functions <br />or responsibilities in the review or approval of the under- <br />taking or carrying out of this project, shall participate in <br />any decision relating to this contract which affects his <br />personal interest or have any personal or pecuniary interest, <br />direct or indirect, in this contract or the proceeds thereof. <br /> <br />9. The CONSULTANT covenants that it presently has no interest <br />and shall Bot acquire any interest, direct or indirect, <br />which would conflict in any manner or degree with the per- <br />formance of services required to be performed under this <br />contract. The CONSULTANT further covenants that in the <br />performance of this contract no person having any such interest <br />shall be employed. <br /> <br />10. No members of or delegate to the Congress of the united States <br />of America, and no Resident Commissioner, shall be admitted <br />to any share or part thereof or to any benefit to arise here- <br />from. <br /> <br />11. It is agreed by the parties hereto that portions of the cost <br />of the project contemplated by this contract are an eligible <br />expense under the Housing and Community Development Act for <br />which the CITY has made application under State Clearing <br />House Identifier Number B-79-HS-48-0505; however, the performance <br />of this contract and the obligations thereunder of both <br />parties shall not be contingent upon receipt of federal assis- <br />tance. <br /> <br />12. In the event that a dispute or disagreement should arise be- <br />tween CITY and CONSULTANT in regard to the performance of <br />any of the provisions or conditions of this contract, said <br />dispute or difference of opinion shall be settled by arbitra- <br />tion in the following manner. CITY shall appoint one arbitrator. <br />CONSULTANT shall appoint one arbitrator, and the two selected <br />shall appoint a third arbitrator. The decision of the majority <br />of said three arbitrators shall be binding on CITY and CONSULTANT <br />and will be final and conclusive as to such dispute or differen~e <br />of opinion. Such arbitration shall be completed as rapidly and <br />expeditiously as possible and within a reasonable time. <br /> <br />13. CONSULTANT shall exercise all reasonable diligence with reference <br />to the accuracy of information and data provided to CITY; <br />however, regardless of the care taken in production, data is <br />only as good as the information furnished by the sources for <br />its content. Care and effort will be exercised in receiving <br />and submitting data from information and records available. <br />CONSULTANT assumes no responsibility for inaccuracy of information <br />furnished to CONSULTANT and shall not be liable for any damage <br />or loss by reason of any material or information furnished by <br />the CITY. <br /> <br />-.5- <br />
