The City Manager reported that his <br />concerns on behalf of City employees had been addressed by the recommend~ <br />at ions of the Ethics Review Commission with certain exceptions. Mr. <br />Gonzalez stated his apprehension with Article I, Sec. 3, A, (3) which <br />implied that spouses of employees could not be employed by persons licensed <br />by the City He. said he had been assured by the City Attorney and members <br />of the Commission that they may be employed if the employment is not a gift <br />or favor. The City Manager stated that he would like more clarification on <br />this section by adding a statement to the effect that future employment <br />would not be jepardized if it is not a gift or favor. Mr. Tenorio I <br />moved again to amend the Ordinance by his original motion to amend. <br />Mr. Cavazos seconded the motion. Mr. Sutton recommended the new <br />Council vote on the Ordinance. Mr. Sutton said he felt the Ordinance <br />should be decided on by the new Council. Mr. Hansen said that the <br />Ordinance had to be adopted by April 9th. Mr. Sutton withdrew his <br />objection. On roll call, the following vote was recorded: <br /> <br />AYE: Breihan, Cavazos, Tenorio <br /> <br />NAY: Hansen, James, Sutton <br /> <br />The motion failed on a tie vote. On the roll call to approve the <br />original motion to adopt the Ordinance on second reading, the following <br />vote was recorded: <br /> <br />AYE: Hansen, James, Cavazos <br /> <br />NAY: Sutton, Tenorio, Breihan <br /> <br />The motion failed with a tie vote. The Ordinance was not approved. <br /> <br />The Mayor introduced for consideration an Ordinance on second reading <br />having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, I <br />TEXAS, APPROVING THE PRICE AND CONDITIONS OF THE SALE BY THE <br />CITY OF SAN MARCOS, TEXAS, OF PART OF LOTS SEVEN (7) AND EIGHT <br />(8) IN BLOCK NO. TWO (2) OF THE J. S. TRAVIS ADDITION TO THE <br />CITY OF SAN ~ffiRCOS, HAYS COUNTY, TEXAS, TO MARVIN GILBREATH; <br />AUTHORIZING THE tffiYOR TO EXECUTE A WARRANTY DEED TO t1ARVIN <br />GILBREATH; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Breihan moved to approve the Ordinance on second reading. Mr. James <br />seconded the motion which passed unanimously. <br /> <br />The next item on the agenda, a request for a parade permit, was with- <br />drawn. <br /> <br />The Mayor introduced for consideration a Resolution having the following <br />caption: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AUTHORIZING ACCEPTANCE OF THE COMPLETION OF WORK ON <br />THE CRAWFORD WATER TOWER IN SAN MARCOS, TEXAS, AUTHORIZING <br />FINAL PAYMENT FOR THIS PROJECT; AND ESTABLISHING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Sutton asked if there might be a problem once the water tank was fl. <br />The City Manager said the original report was based on a one million <br />gallon tank and not a 500,000 gallon one. He said staff was now <br />trying to determine what difference that might make and assured Counci <br />that there was no immediate problem. Mr. Cavazos moved itO approve <br />the Resolution. Mr. Tenorio seconded the mowion which passed unanimously. <br />
