The City Hanager <br />stated that the Sanitation Dept. was requesting to go with the low bidder, <br />even though he had a deviation from the required gauge of steel from 16 <br />to 14. The City Manager checKed with the City Attorney about accepting <br />the bid even with the deviation and she said the Council could accept <br />a minor deviation. The City Manager recommended that the 2nd and 3rd <br />lowest bidders be contacted and allowed to bid on the 14 gauge steel lids. <br />He said it would only take a couple of days to negotiate the submission <br />of the bid. Mr. Cavazos made a motion to aceept the second lowest bid, <br />EMCO, which did not have a deviation. Mr. Sutton seconded the motion which <br />passed unanimously. <br /> <br />The Mayor introduced for consideration a special meeting to be called <br />for Monday, April 7, 1980 at 5:00 p.m. to canvass election returns. Mr. <br />Brc~ihan made a mot ion to schedule the meeting. Mr. James seconded the <br />motion which passed unanimously. The Mayor introduced for consideration <br />giving consent to FmHA financing of a water system purchase in the extra- <br />territorial jurisdiction of San Marcos. George Patton, from Austin, repre- <br />senting the residents on Haysco Water System addressed the Council about <br />their plan to try and purchase the water system wi.th the help of FmHA. <br />Mr. James said that he wanted legal advice from the City Attorney before th <br />Council made any decisions on this item and requested an Executive Session. <br />Mr. Tenorio asked Mr. Patton if he was on a timetable and he said no. <br />Mr. Breihan made a motion to go into executive session at 10:00 p.m. <br />Mr. Cavazos seconded the motion. On roll call, the following vote was <br />recorded: <br /> <br />AYE: Breihan, Cavazos, James, Sutton, Tenorio <br /> <br />NAY: Hansen <br /> <br />The Council reconvened in regular session at 10:15 p.m. on motion of Mr. <br />Cavazos and second of Mr. Breihan. Mr. James moved to table further <br />consideration and that the City Manager be authorized to research the <br />matter further. Mr. Breihan seconded the motion which passed unanimously. <br /> <br />Mr. James moved to reconsider action taken on Item lO-A and to approve <br />the Ethics Ordinance on second reading in the form approved on first <br />reading. Mr. Tenorio seconded the motion. On roll call, the following <br />vote was recorded: <br /> <br />AYE: Tenorio, Cavazos, Hansen, James <br /> <br />NAY: Sutton, Breihan <br /> <br />Mr. James moved <br />Special Meeting <br />until 7:00 p.m. <br />following vote: <br /> <br />to schedule third reading of the Ordinance at the <br />scheduled for April 7 with consideration not to begin <br />Mr. Tenorio seconded the motion, which passed with the <br /> <br />AYE: Tenorio, Cavazos, Hansen, James <br /> <br />NAY: Breihan, Sutton <br /> <br />Mr. Hansen introduced a request by Mr. Tom Woods for a parade permit. <br />Mr. Woods came before the Council to say that he had previously obtained <br />permits for similar parades in past years, but had been denied a permit <br />for a parade to be held on April 26. The City Manager explained that <br />the Director of Public Safety had determined that the City would be <br />required to incur expenses in connection with the activity which had not <br />been budgeted. Mr. Minnie further explained that additional concerns <br />were the expanded parade route, an increase in the number of units in <br />the parade, the fact that there was no formal organization to sponsor <br />the activity, and the fact that the parade was intended to end on property <br />on Cheatham Street near a residential area with a "keg" party.
