No changes in <br />these plans and spec1ticatlons are to be m3de vdtbout the written consent of such <br />changes by said Direotor and said Chief Engimer. <br />2. Railroad Company hereby agrees to grant to city permission fer the construe- <br /> <br />t.:lon, maintSlance and use of a public street across its main line right or way at <br />grade for the purpose of recor.structing Patton street across said Railroad right <br />of way at the location described in Exhibit "A". <br /> <br />3. Railroad Company, subject to reimbursement by City of the cost thereof', <br />will furnish material, equipment and labor to install a 32 foot prefab tUJber <br /> <br />crossing in said street. The estimated cost to install said crossing is Ten <br /> <br />thousand, three hundred twenty dollars ($].0,320). It is agreed betlveon the parties <br /> <br />hereto that the aforesaid eoat figure is an estirnete on].;;", and City agrees to reim- <br />burse Railroad Cc:rnpany for its actual cost in furnishing said lIlE'.terials, equipment <br /> <br />and labor, including all additives to .:w.terial and labor, in compliance with Rail- <br />road Company's current bill.ing practices. City will. likewise install a.nd maintain, <br /> <br />or cause to be installed and maintained, at its own exponse, all street paving in- <br /> <br />eluding curbs and gutters, on Railroad Compa1Vf's right of way.
