<br />I <br /> <br />I <br /> <br />I <br /> <br />, , <br /> <br />'I , ~ <br /> <br />3b <br /> <br />.. <br /> <br />STATE OF TEXAS <br /> <br />ENGINEERING SERVICES N;REEHEN'" <br />FOR REVISIONS TO BISHOP STW-;i;'i' <br />IMPROVEMENTS CONSTRUCTiON PLANS <br />SPECIFICATIONS <br /> <br />COUNTY OF HAYS <br /> <br />THIS AGREEMENT, made and entered into this 25th day of June , <br /> <br />1980 by and between the City of San Marcos, Texas, a municipal <br /> <br />corporation organized and existing under the laws of the State of <br /> <br />Texas and situated in Hays County, Texas, acting through authority <br /> <br />conferred on city manager A.C. Gonzalez by Resolution <br /> <br />adopted June 16 <br /> <br />1980, hereinafter called "City" and Dabney- <br /> <br />Byrn and Associates, Inc. hereinafter c<l11ed "Engineer". <br /> <br />WHEREAS, City desires to make paving and drainage improvements <br /> <br />to Bishop Street, said street being located within the corporate <br /> <br />limits of city, ln connection witt its Community Development Project <br /> <br />B-77-Hs-48-0S0S to be known as the Bishop Street Paving and Drainagl <br /> <br />Improvements Project hereinafter "Project"; <br /> <br />WHEREAS, City desires such improvements to consist of street <br /> <br />pavlng, and drainage appurtenances, and other amrnenities necessary <br /> <br />ln such improvements; and, <br /> <br />WHEREAS, City desires to obtain professional engineering serVlces <br /> <br />ln connection with the Project, such services to include deslgn <br /> <br />concepts for improvements; revisions of the existing plans and <br /> <br />specifications for construction; and administration of the contract <br /> <br />during the construction phase; and <br /> <br />WHEREAS, Engineer is qualified and capable of performins the <br /> <br />professional engineering services proposed hereln, is acceptable to <br /> <br />City and is willing to enter into an agreement with City to perform <br /> <br />such serVlces. <br /> <br />NOW, THEREFORE, be it resolved, that the parties hereto do <br /> <br />mutually agree as follows; <br /> <br />ARTICLE I. <br />EMPLOYMENT OF THE ENGINEER <br /> <br />City agrees to retain Engineer and Engineer agrees to perform <br /> <br />professional engineering services in connection with Project as set <br /> <br />forth in sections following; and City agrees to pay and Engineer <br /> <br />agrees to accept fees as specified in sections following ~s Iull <br /> <br />and final compensation for work accomplished. <br /> <br />Said services shall be <br /> <br />Close related to street paving, drainage appurtenances, water and <br />
