<br />-4- <br /> <br />I <br /> <br />airport facilities duting any activity conducted pursuant to <br />this lease agreement. Such aircraft shall be under direction of <br />Lessee's representatives for tiedown specifications during this <br /> <br />period of time. All aircraft movements during aerobatic compe- <br /> <br /> <br />tition will be under control of Lessee or FAA. Movements shall <br /> <br /> <br />be coordinated with the San Marcos Municipal Airport Fixed Base <br /> <br /> <br />Operator and/or FAA. Aircraft with hangar space shall have <br /> <br />continuous access to and from hangar area. <br /> <br />XI. <br /> <br />During time of war or national emergency, City shall have <br /> <br />the right to lease the landing area, airport or any part there- <br /> <br />of to the United States Government for military or naval use, <br /> <br />and if such lease is executed, the provisions of this instrument <br /> <br /> <br />insofar as they are inconsistent with the provisions of the <br /> <br /> <br />lease to the Government, shall be suspended. This lease shall <br /> <br />I <br /> <br />be subordinate to the provisions of any existing or future agree- <br /> <br />ment between City and the United States, relative to the operation <br /> <br />of maintenance of the airport, the execution of which has been <br /> <br /> <br />or may be required as a condition precedent to the expenditure <br /> <br /> <br />of Federal funds for the development of the airport. <br /> <br />XII. <br /> <br />City agrees to wa1ve its right to object to an assignment <br />or transfer of rights and privileges by Arnold Shaeferkoeter to <br />Lessee for the period of time described in Part I under the terms <br />of the agricultural lease agreement entered into by City and Mr. <br />Shaeferkoeter on January 1, 1977. Lessee shall agree in writing <br />to abide by and accept all the provisions of said lease agree- <br />ment between City and Mr. Shaerferkoeter. <br /> <br />XIII. <br />I The City of San Marcos Airport Commission shall approve all <br />facilities to be installed by Lessee. <br /> <br />XIV. <br /> <br />It is specifically understood and agreed that nothing con- <br /> <br />stained herein shall be construed as a granting or authorizing <br /> <br />the granting of an exclusive right for exercising of an aero- <br /> <br />nautical activity, nor to conduct any activity which is dis- <br />
