<br />I <br /> <br />I <br /> <br />I <br /> <br />whenever said damages, claims, losses, demands, suits, judgments, <br /> <br />costs or expenses are caused in whole or in part by any negligent <br />act or omission of Flight Operations, anyone directly or indirectly <br />employed by Flight Operations or anyone for whose acts Flight <br /> <br />Operations may be liable regardless of whether said damages, claims, <br /> <br />losses, demand, suits, judgments, costs or expenses are caused in <br /> <br />part by City. <br /> <br />XVI. <br />Flight Operations shall store its property in, and shall occupy <br />said demised premises and all other portions of Airport at its own <br />risk. City shall not be responsible or liable at any time for any <br />loss to or damage of Flight Operations' merchandise, equipment, fixtures, <br />machinery, airplanes or airplane parts or any other personal property <br />of Flight Operations' business at Airport. <br />XVII. <br />All covenants, terms and conditions of this lease must be <br />approved by the Federal Aviation Administration before the effective <br /> <br />date of this lease agreement. <br /> <br />XVIII. <br />No rights privileges under this agreement shall be sold, trans- <br />ferred, assigned or subleased by Flight Operations nor shall they pass <br />to any other person without the written consent of City. <br />XIX. <br />Flight Operations shall have the right to erect such temporary <br />structures as it shall deem necessary on said demised premises; provided, <br />however, that such structures shall be ln conformity with all applicable <br />requirements of the Code of Ordinances of the City of San Marcos. At <br />the termination of this lease any structures so constructed shall be <br />removed by Flight Operations; provided, however, that said structures <br />may remain upon agreement by the parties as to adequate compensation <br />for said structures. <br /> <br />6 <br />
