<br />I <br /> <br />,- <br /> <br />General: <br /> <br />A. The contractor seeking to establish the good faith effort <br />as required by paragraph (E) shall as a minimum set forth <br />evidence acceptable to the Secretary that it has; <br /> <br />1. <br /> <br />Attempted to recruit from the appropriate areas necessary, <br />number of low income residents through; local advertising <br /> <br />community organizations and public or private institutions <br /> <br />operating within or serving the project area such as; a <br /> <br />citizens advisory committee, community service agencies. or <br /> <br />the U:S. Employment Service. <br />B. The contractor which fills vacant paragraph (0) employment <br /> <br />positions in its organization immediately prior to under- <br /> <br />taking work pursuant to a Section 3 covered contract shall <br /> <br />set evidence acceptable to the Secretary that its actions <br /> <br />were not an attempt to circumvent those regulations. <br /> <br />C. When lower income resident workers apply either on their <br /> <br />own initiative or on refferal from any source, the con- <br /> <br />I <br /> <br />tractor shall determine the q~alifications of such persons <br /> <br />and shall employ such persons if their qualifications are <br /> <br />satisfactory and the contractor has openlngs. If the contrac- <br /> <br />tor is unable to employ the worker, such person shall be con- <br /> <br />sidered for the first available openings. <br /> <br />o.
