<br />I <br /> <br />I <br /> <br />I <br /> <br />9A <br /> <br />STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />ENGINEERING SERVICES AGREEMENT <br />FOR VICTORY GARDENS PHASE III <br />IMPROVEMENTS <br /> <br />THIS AGREEMENT, made and entered into this 23rd day of <br />September, 1980, by and between the City of San Marcos, Texas, <br />a municipal corporation organized and existing under the laws <br />of the State of Texas and situated in Hays County, Texas, acting <br />through authority conferred on City Manager, A. C. Gonzalez, by <br />Resolution 1980- , adopted September 22,1980 , hereinafter <br />called "City" and Pro-Tech Engineering Group, Inc., hereinafter <br />called "Engineer". <br /> <br />WHEREAS, City intends to construct street paving, drainage, <br />utility and sidewalk improvements on Eisenhower, Georgia, Arizona <br />and Valley Streets, said construction to be termed Victory Gardens <br />Phase III Improvements, hereinafter called "Improvements"; <br /> <br />WHEREAS, City desires to obtain professional engineering <br />service in connection with Improvements, such services to include <br />preparation of design documents and plans and specifications for <br />construction and administration of the contract during the <br />construction phase; <br /> <br />WHEREAS, Engineer is qualified and capable of performing the <br />professional engineering services proposed herein, is acceptable <br />to City and is willing to enter into an agreement with City to <br />perform such services. <br /> <br />NOlv, THEREFORE, be it resolved, that the parties hereto do <br />mutually agree as follows: <br /> <br />ARTICLE I <br />EMpLOYMENT OF ENGINEER <br /> <br />City agrees to retain Engineer and Engineer agrees to perform <br />professional engineering services in connection with the Improvements <br />as set forth in sections following; and City agrees to pay and <br />Engineer agrees to accept fees as specified in sections following <br />as full and final compensation for work accomplished. Said services <br />shall be those related to the construction of street paving, <br />drainage, utility and sidewalk improvements on Eisenhower, Georgia, <br />Arizona and Valley Streets. <br /> <br />ARTICLE II <br />ENGINEER'S SERVICES <br /> <br />A. Engineer shall not commence work on project until <br />written notification is received from City. Engineer <br />will perform the following professional services <br />as necessary for the development of Improvements <br />to final completion. <br /> <br />B. The scope and character of the services are as follows: <br /> <br />1. Preliminary Design Phase <br />After written authorization to proceed with the <br />Preliminary Design Phase, Engineer shall: <br /> <br />at prepare preliminary design documents <br />consisting of final design criteria, <br />preliminary drawings and outline <br />specifications. <br />
