<br />I <br /> <br />I <br /> <br />I <br /> <br />58 <br /> <br />special meeting <br /> <br />november 3, 1980 <br /> <br />page five <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING APPENDIX A, THE GENERAL ZONING ORDINANCE, <br />OF THE CODE OF ORDINANCES OF SAID CITY BY CHANGING THE <br />MINIMUM REAR SETBACK REQUIREMENTS IN D, M, P-l, P-2, <br />C AND I DISTRICTS; BY CHANGING TE~1INOLOGY; BY SETTING <br />REQUIREMENTS FOR ACCESSORY BUILDINGS; BY REGULATING THE <br />HEIGHT OF FENCES AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Brown moved to approve the Ordinance on first reading. Mr. James <br />seconded the motion. The Mayor recommended that rear yard setback <br />for multi-family be 5' up to 24' height of structure with 2' added for <br />each story up to the required front setback. Mr. Stokes moved to amend <br />the Ordinance so that no portion of a multi-family building shall be <br />closer than 5' to the rear property line and shall be setback an <br />additional 2' for each story over 241 from the ground floor or 2 <br />stories, whichever is least. Mrs. Norris seconded the motion. On roll <br />call, the following vote was recorded: <br /> <br />AYE: Cavazos, James, Kraus, Norris, Stokes, Tarbutton <br /> <br />NAY: Brown <br /> <br />On the original motion to approve the Ordinance on first reading, the <br />following vote was recorded: <br /> <br />AYE: Cavazos, James, Kraus, Norris, Stokes, Tarbutton <br /> <br />NAY: Brown <br /> <br />Mr. Stokes moved the Council recess to executive session at 8:00 p.m. <br />Mrs. Norris seconded the motion, which passed unanimously. <br /> <br />The Council reconvened in regular session at 9:35 p.m. on motion of <br />Mrs. Norris and second of Mr. Brown. On the acquisition of property <br />item, Mr. James moved to instruct the City Manager to take the contract <br />approved by Council for the sanitary landfill to Mr. Yarrington for <br />his approval. Mr. Tarbutton seconded the motion, which passed unanimously. <br />On the personnel item, !ir. James moved to forward a letter to the Ethics <br />Review Commission concerning their findings in the case of John Stokes. <br />A copy of that letter is attached and made a part of these minutes. ~1rs. <br />Norris seconded the motion, which passed unanimously. <br /> <br />The meeting adjourned at 9:37 p.m. on motion of Mrs. Norris and second <br />of Mr. Tarbutton. <br /> <br />K~O:! w~.
