I I I 72~ ~HE STATE OF TEXAS CONTRACT FOR DEMOLITION OF OLD CITY HALL ANNEX COUNTY OF HAYS KNOW ALL MEN BY THESE PRESENTS: That the City of San Marcos, Texas, a municipal corporation located in Hays County, Texas existing by and under the laws of the State of Texas, acting through authority conferred on its City Manager, A. C. Gonzalez, by resolution duly enacted on November 24, 1980, hereinafter "City" and Jones Demolition, hereinafter "Contractor", enter into this contract for the demolition of the structure known as Old City Hall Annex located within the City of San Marcos. I. For and in consideration of permission by City to remove and retain all salvageable materials obtained pursuant to the terms of this Contract and the payment of $8,730.00, Contractor agrees to demolish that structure known as Old City Hall Annex located on the southern one half of Lots number one (1) and two (2) in Block number twenty (20) of the Original Town of San Marcos according to a map or plat of said town, of record in Volume 46, Page 448, of the Deed Records of Hays County, Texas, and to clear away all earth, rubbish, debris and salvageable materials from the premises. If written request is made by City, Contractor agrees to remove the concrete slab remaining after said demolition. II. Contractor shall, within ten (10) days after being instructed to do so in a written notice from City, commence the work to be done under this Contract. III. It is expressly agreed that time is of the essence in this Contract. Contractor shall complete said demolition within 90 days of said commencement. If Contractor shall fail to do so, Contractor shall pay to City fifty dollars ($50.00) per day, not as a penalty,
