<br />but as liquidated damages, for each and every day the work <br /> <br />shall remain unfinished after the 90th day. Should Contractor <br /> <br />be delayed in the completion of the work by any act or neglect <br /> <br />of City, or of any employee of City, or by strikes, lockouts, fires, <br /> <br />or unavoidable cause or causes beyond Contractor's control, then <br /> <br /> <br />an extension of time shall be allowed for completing the work, <br /> <br /> <br />II provided, however that Contractor shall give City prompt notice ln <br /> <br /> <br />writing of the cause of such delay. <br /> <br />IV. <br /> <br />Contractor shall provide and pay for all materials, supplies, <br /> <br /> <br />machinery, equipment, tools, superintendence, labor, services, <br /> <br /> <br />insurance, and all water, light, power, fuel, transportation and <br /> <br />other facilities necessary for the execution and completion of <br />the work covered by this Contract. <br /> <br />V. <br /> <br />I <br /> <br />Contractor shall be responsible for the care, preservation, <br /> <br />conservation, and protection of all materials, supplies, machinery, <br /> <br />equipment, tools, apparatus, accessories, and facilities necessary <br /> <br />for the execution and completion of the work covered by this con- <br /> <br />tract until the work is completed to the satisfaction of City. <br /> <br />VI. <br /> <br />Contractor shall take all necessary precautions for the <br /> <br /> <br />safety of employees and others at or near the work and shall <br /> <br /> <br />comply with all applicable provisions of federal, state and muni- <br /> <br /> <br />cipal safety laws and building and construction codes. <br /> <br />VII. <br /> <br />I <br /> <br />Contractor shall take proper means to protect the adjacent <br />or adjoining property or properties in any way encountered, which <br />might be injured or seriously affected by the work described by <br />this Contract, from any damage or injury and Contractor shall be <br />liable for any and all claims for such damage on account of <br />Contractor's failure to fully protect all adjoining property. <br />Contractor agrees to indemnify, save and hold harmless City <br /> <br />2 <br />
